For the purposes of this section, \"racial profiling\" means\n\nthe detention, interdiction or other disparate treatment of an\n\nindividual solely on the basis of the racial or ethnic status of\n\nsuch individual.\n\nB. No officer of any municipal, county or state law enforcement\n\nagency shall engage in racial profiling.\n\nC. The race or ethnicity of an individual shall not be the sole\n\nfactor in determining the existence of probable cause to take into\n\ncustody or to arrest an individual or in constituting a reasonable\n\nand articulable suspicion that an offense has been or is being\n\ncommitted so as to justify the detention of an individual or the\n\ninvestigatory stop of a motor vehicle.\n\nD. A violation of this section shall be a misdemeanor.\n\nE. Every municipal, county, and state law enforcement agency\n\nshall adopt a detailed written policy that clearly defines the\n\nelements constituting racial profiling. Each agency’s policy shall\n\nprohibit racial profiling based solely on an individual’s race or\n\nethnicity. The policy shall be available for public inspection\n\nduring normal business hours.\n\nF.
