Stat. tit. 22, § 22-40.3A","heading":"Reporting of rape, sodomy, or sexual assault incidents –","body":"Referral of victim to services programs – Production of records to\n\nlaw enforcement officers.\n\nA. Any physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending, or treating the victim of what appears to be\n\nor is reported by the victim to be rape, rape by instrumentation or\n\nforcible sodomy, as defined in Section 1111, 1111.1 or 888 of Title\n\n21 of the Oklahoma Statutes or any form of sexual assault, shall not\n\nbe required to report any incident of what appears to be or is\n\nreported to be such crimes if:\n\n1. Committed upon a person who is over the age of eighteen (18)\n\nyears; and\n\n2. The person is not an incapacitated adult.\n\nB. Any physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending, or treating a victim shall be required to\n\nreport any incident of what appears to be or is reported to be rape,\n\nrape by instrumentation, forcible sodomy or any form of sexual\n\nassault, if requested to do so either orally or in writing by the\n\nvictim and shall be required to inform the victim of the victim's\n\nright to have a report made. A requested report of any incident\n\nshall be promptly made orally or by telephone to the nearest law\n\nenforcement agency in the county wherein the sexual assault occurred\n\nor, if the location where the sexual assault occurred is unknown,\n\nthe report shall be made to the law enforcement agency nearest to\n\nthe location where the injury is treated.\n\nC. In all cases of what appears to be or is reported to be\n\nrape, rape by instrumentation, forcible sodomy or any form of sexual\n\nassault, the physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending, or treating the victim of what appears to be\n\nsuch crimes, shall clearly and legibly document the incident and\n\ninjuries observed and reported, as well as any treatment provided or\n\nprescribed.\n\nD. In all cases of what appears to be or is reported to be\n\nrape, rape by instrumentation, forcible sodomy or any form of sexual\n\nassault, the physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending, or treating the victim of what appears to be\n\nrape, rape by instrumentation, forcible sodomy or any form of sexual\n\nassault, shall refer the victim to sexual assault and victim\n\nservices programs, including providing the victim with twenty-four-\n\nhour statewide telephone communication service established by\n\nSection 18p-5 of Title 74 of the Oklahoma Statutes.\n\nE. Every physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nmaking a report of rape, rape by instrumentation, forcible sodomy or\n\nany form of sexual assault pursuant to this section or examining\n\nsuch victims to determine the likelihood of such crimes, and every\n\nhospital or related institution in which the victims were examined\n\nor treated shall, upon the request of a law enforcement officer\n\nconducting a criminal investigation into the case, provide to the\n\nofficer copies of the results of the examination or copies of the\n\nexamination on which the report was based, and any other clinical\n\nnotes, X-rays, photographs, and other previous or current records\n\nrelevant to the case.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b47c7a24328d7dd52d007eb0074e01d3722876222d8c17741061fcaff42269fe","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-40.3","next":"us-ok/okla.-stat.-tit.-22-22-40.5"},"notice":"GroundRules: Original legal text.
