Stat. tit. 22, § 22-524","heading":"Preliminary hearing on felony indictment - Time for","body":"request - Witnesses - Dismissal.\n\nUpon the return and filing of an indictment for a felony, the\n\ndefendant so charged and arrested thereon, or the state, upon filing\n\na request in writing, shall be entitled to have a copy of said\n\nindictment, certified by the court clerk, filed with a district,\n\nsuperior, common pleas or county judge, to be designated by the\n\nJudge presiding over the grand jury, and the defendant shall have a\n\npreliminary hearing thereon, before such designated judge, as a\n\nmagistrate, as though said charge had been originally filed by\n\nverified information, with such magistrate, and under the law\n\napplying to the institution and conduct of prosecutions by\n\ninformation filed by the state. Any such request must be filed\n\nwithin ten (10) days after the filing of such indictment with the\n\ncourt clerk, or within ten (10) days after the defendant charged\n\nunder said indictment has been arrested thereon, whichever is later.\n\nUpon such preliminary hearing, the members of the grand jury shall\n\nnot be subpoenaed or called as a witness except upon an indictment\n\ncharging the commission of the offense of perjury before the grand\n\njury. The names of witnesses other than those endorsed on the\n\nindictment may be endorsed on the indictment prior to said\n\npreliminary hearing and such additional persons may be called as\n\nwitnesses at such preliminary hearing; provided, that this section\n\nshall not apply to motion to quash or vacate the grand jury\n\nproceedings or indictment upon other grounds.
