Criminally injurious conduct, as defined by the Oklahoma\n\nCrime Victims Compensation Act, which appears to be or is reported\n\nby the victim to be domestic abuse, as defined in Section 60.1 of\n\nthis title, or domestic abuse by strangulation, domestic abuse\n\nresulting in great bodily harm, or domestic abuse in the presence of\n\na child, as defined in Section 644 of Title 21 of the Oklahoma\n\nStatutes, shall be reported according to the standards for reporting\n\nas set forth in subsection B of this section.\n\nB. Any physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending, or treating the victim of what appears to be\n\ndomestic abuse or is reported by the victim to be domestic abuse, as\n\ndefined in Section 60.1 of this title, or domestic abuse by\n\nstrangulation, domestic abuse resulting in great bodily harm, or\n\ndomestic abuse in the presence of a child, as defined in Section 644\n\nof Title 21 of the Oklahoma Statutes, shall not be required to\n\nreport any incident of what appears to be or is reported to be\n\ndomestic abuse, domestic abuse by strangulation, domestic abuse\n\nresulting in great bodily harm, or domestic abuse in the presence of\n\na child if:\n\n1. Committed upon the person of an adult who is over the age of\n\neighteen (18) years; and\n\n2. The person is not an incapacitated adult.\n\nC. Any physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending, or treating a victim shall be required to\n\nreport any incident of what appears to be or is reported to be\n\ndomestic abuse, domestic abuse by strangulation, domestic abuse\n\nresulting in great bodily harm, or domestic abuse in the presence of\n\na child, if requested to do so either orally or in writing by the\n\nvictim. A report of any incident shall be promptly made orally or\n\nby telephone to the nearest law enforcement agency in the county\n\nwherein the domestic abuse occurred or, if the location where the\n\nconduct occurred is unknown, the report shall be made to the law\n\nenforcement agency nearest to the location where the injury is\n\ntreated.\n\nD. In all cases of what appears to be or is reported to be\n\ndomestic abuse, the physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending, or treating the victim of what appears to be\n\ndomestic abuse shall clearly and legibly document the incident and\n\ninjuries observed and reported, as well as any treatment provided or\n\nprescribed.\n\nE. In all cases of what appears to be or is reported to be\n\ndomestic abuse, the physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nexamining, attending or treating the victim of what appears to be\n\ndomestic abuse shall refer the victim to domestic violence and\n\nvictim services programs, including providing the victim with the\n\ntwenty-four-hour statewide telephone communication service\n\nestablished by Section 18p-5 of Title 74 of the Oklahoma Statutes.\n\nF. Every physician, surgeon, resident, intern, physician\n\nassistant, registered nurse, or any other health care professional\n\nmaking a report of domestic abuse pursuant to this section or\n\nexamining a victim of domestic abuse to determine the likelihood of\n\ndomestic abuse, and every hospital or related institution in which\n\nthe victim of domestic abuse was examined or treated shall, upon the\n\nrequest of a law enforcement officer conducting a criminal\n\ninvestigation into the case, provide copies of the results of the\n\nexamination or copies of the examination on which the report was\n\nbased, and any other clinical notes, x-rays, photographs, and other\n\nprevious or current records relevant to the case to the\n\ninvestigating law enforcement officer.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2d78cfbb4db0e37c5f80cc71670f42ca1e0c71d1d09a68ca7f26569a497cc15b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-576","next":"us-ok/okla.-stat.-tit.-22-22-581"},"notice":"GroundRules: Original legal text.
