Stat. tit. 22, § 22-60.1","heading":"Definitions","body":"As used in the Protection from Domestic Abuse Act and in the\n\nDomestic Abuse Reporting Act, Sections 40.5 through 40.7 of this\n\ntitle, and Section 150.12B of Title 74 of the Oklahoma Statutes:\n\n1. “Dating relationship” means intimate association, primarily\n\ncharacterized by affectionate or sexual involvement. For purposes\n\nof this act, a casual acquaintance or ordinary fraternization\n\nbetween persons in a business or social context shall not constitute\n\na dating relationship;\n\n2. “Domestic abuse” means any act of physical harm or the\n\nthreat of imminent physical harm which is committed by an adult,\n\nemancipated minor, or minor child thirteen (13) years of age or\n\nolder against another adult, emancipated minor or minor child who is\n\ncurrently or was previously an intimate partner or family or\n\nhousehold member;\n\n3. “Family or household members” means:\n\na. parents, including grandparents, stepparents, adoptive\n\nparents and foster parents,\n\nb. children, including grandchildren, stepchildren,\n\nadopted children and foster children,\n\nc. persons otherwise related by blood or marriage living\n\nin the same household,\n\nd. persons otherwise related by blood or marriage, or\n\ne. persons not related by blood or marriage living in the\n\nsame household;\n\n4. “Foreign protective order” means any valid order of\n\nprotection issued by a court of another state or a tribal court;\n\n5. “Harassment” means a knowing and willful course or pattern\n\nof conduct by a family or household member or an individual who is\n\nor has been involved in a dating relationship with the person,\n\ndirected at a specific person which seriously alarms or annoys the\n\nperson, and which serves no legitimate purpose. The course of\n\nconduct must be such as would cause a reasonable person to suffer\n\nsubstantial emotional distress and must actually cause substantial\n\ndistress to the person. “Harassment” shall include, but not be\n\nlimited to, harassing or obscene telephone calls in violation of\n\nSection 1172 of Title 21 of the Oklahoma Statutes and fear of death\n\nor bodily injury;\n\n6. “Intimate partner” means:\n\na. current or former spouses,\n\nb. persons who are or were in a dating relationship,\n\nc. persons who are the biological parents of the same\n\nchild, regardless of their marital status or whether\n\nthey have lived together at any time, and\n\nd. persons who currently or formerly lived together in an\n\nintimate way, primarily characterized by affectionate\n\nor sexual involvement. A sexual relationship may be\n\nan indicator that a person is an intimate partner, but\n\nis never a necessary condition;\n\n7. “Living in the same household” means:\n\na. persons who regularly reside in the same single-\n\ndwelling unit,\n\nb. persons who resided in the same single-dwelling unit\n\nwithin the past year, or\n\nc. persons who have individual lease agreements whereby\n\neach person has his or her own private bedroom and\n\nshares the common areas;\n\n8. “Mutual protective order” means a final protective order or\n\norders issued to both a plaintiff who has filed a petition for a\n\nprotective order and a defendant included as the defendant in the\n\nplaintiff’s petition restraining the parties from committing\n\ndomestic violence, stalking, harassment or rape against each other.\n\nIf both parties allege domestic abuse, violence, stalking,\n\nharassment or rape against each other, the parties shall do so by\n\nseparate petition pursuant to Section 60.4 of this title;\n\n9. “Rape” means rape and rape by instrumentation in violation\n\nof Sections 1111 and 1111.1 of Title 21 of the Oklahoma Statutes;\n\n10. “Stalking” means the willful, malicious, and repeated\n\nfollowing or harassment of a person by an adult, emancipated minor,\n\nor minor thirteen (13) years of age or older, in a manner that would\n\ncause a reasonable person to feel frightened, intimidated,\n\nthreatened, harassed, or molested and actually causes the person\nviolation\n\nof Sections 1111 and 1111.1 of Title 21 of the Oklahoma Statutes;\n\n10. “Stalking” means the willful, malicious, and repeated\n\nfollowing or harassment of a person by an adult, emancipated minor,\n\nor minor thirteen (13) years of age or older, in a manner that would\n\ncause a reasonable person to feel frightened, intimidated,\n\nthreatened, harassed, or molested and actually causes the person\n\nbeing followed or harassed to feel terrorized, frightened,\n\nintimidated, threatened, harassed or molested. Stalking also means\n\na course of conduct composed of a series of two or more separate\n\nacts over a period of time, however short, evidencing a continuity\n\nof purpose or unconsented contact with a person that is initiated or\n\ncontinued without the consent of the individual or in disregard of\n\nthe expressed desire of the individual that the contact be avoided\n\nor discontinued. Unconsented contact or course of conduct includes,\n\nbut is not limited to:\n\na. maintaining a visual or physical proximity to the\n\nindividual,\n\nb. approaching or confronting that individual in a public\n\nplace or on private property,\n\nc. appearing at the workplace of the individual or\n\ncontacting the employer or coworkers of the\n\nindividual,\n\nd. appearing at the residence of the individual or\n\ncontacting the neighbors of the individual,\n\ne. entering onto or remaining on property owned, leased\n\nor occupied by the individual,\n\nf. contacting the individual by telephone, text message,\n\nelectronic message, electronic mail, or other means of\n\nelectronic communication or causing the telephone or\n\nelectronic device of the individual or the telephone\n\nor electronic device of any other person to ring or\n\ngenerate notifications repeatedly or continuously,\n\nregardless of whether a conversation ensues,\n\ng. photographing, videotaping, audiotaping, or, through\n\nany other electronic means, monitoring or recording\n\nthe activities of the individual. This subparagraph\n\napplies regardless of where the act occurs,\n\nh. sending any physical or electronic material or\n\ncontacting the individual by any means, including any\n\nmessage, comment, or other content posted on any\n\nInternet site or web application,\n\ni. sending to a family member or member of the household\n\nof the individual, or any current or former employer\n\nof the individual, or any current or former coworker\n\nof the individual, or any friend of the individual,\n\nany physical or electronic material or contacting such\n\nperson by any means, including any message, comment,\n\nor other content posted on any Internet site or web\n\napplication, for the purpose of obtaining information\n\nabout, disseminating information about, or\n\ncommunicating with the individual,\n\nj. placing an object on, or delivering an object to,\n\nproperty owned, leased or occupied by the individual,\n\nk. delivering an object to a family member or member of\n\nthe household of the individual, or an employer,\n\ncoworker, or friend of the individual, or placing an\n\nobject on, or delivering an object to, property owned,\n\nleased, or occupied by such a person with the intent\n\nthat the object be delivered to the individual, or\n\nl. causing a person to engage in any of the acts\n\ndescribed in subparagraphs a through k of this\n\nparagraph; and\n\n11. “Victim support person” means a person affiliated with a\n\ndomestic violence, sexual assault or adult human sex trafficking\n\nprogram, certified by the Attorney General or operating under a\n\ntribal government, who provides support and assistance for a person\n\nwho files a petition under the Protection from Domestic Abuse Act.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"32ba63e269f60eacb75410fcb2b00b6b75c3faef772a23f737f01a0a61c04312","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-60","next":"us-ok/okla.-stat.-tit.-22-22-60.11"},"notice":"GroundRules: Original legal text.
