Stat. tit. 22, § 22-60.3","heading":"Emergency ex parte order and hearing - Emergency","body":"temporary ex parte order of protection.\n\nA. If a plaintiff requests an emergency ex parte order pursuant\n\nto Section 60.2 of this title, the court shall hold an ex parte\n\nhearing on the same day the petition is filed, if the court finds\n\nsufficient grounds within the scope of the Protection from Domestic\n\nAbuse Act stated in the petition to hold such a hearing. The court\n\nmay, for good cause shown at the hearing, issue any emergency ex\n\nparte order that it finds necessary to protect the victim from\n\nimmediate and present danger of domestic abuse, stalking, or\n\nharassment. The emergency ex parte order shall be in effect until\n\nafter the full hearing is conducted. Provided, if the defendant,\n\nafter having been served, does not appear at the hearing, the\n\nemergency ex parte order shall remain in effect until the defendant\n\nis served with the permanent order. If the terms of the permanent\n\norder are the same as those in the emergency order, or are less\n\nrestrictive, then it is not necessary to serve the defendant with\n\nthe permanent order. The Administrative Office of the Courts shall\n\ndevelop a standard form for emergency ex parte protective orders.\n\nB. An emergency ex parte protective order authorized by this\n\nsection shall include the name, sex, race, date of birth of the\n\ndefendant, and the dates of issue and expiration of the protective\n\norder.\n\nC. 1. If a plaintiff requests an emergency temporary ex parte\n\norder of protection as provided by Section 40.3 of this title, the\n\njudge who is notified of the request by a peace officer may issue\n\nsuch order verbally to the officer or in writing when there is\n\nreasonable cause to believe that the order is necessary to protect\n\nthe victim from immediate and present danger of domestic abuse.\n\nWhen the order is issued verbally the judge shall direct the officer\n\nto complete and sign a statement attesting to the order. The\n\nemergency temporary ex parte order shall be in effect until the\n\ncourt date that was assigned by the court during the approval of the\n\norder. Emergency temporary ex parte orders shall be heard within\n\nfourteen (14) days after issuance. The court shall provide a list\n\nof available court dates for hearings.\n\n2. The peace officer shall make every attempt to serve the\n\nsubject of the order and complete a return of service when filing\n\nthe petition with the district court. If the peace officer is\n\nunable to obtain service, the petition shall be filed by a peace\n\nofficer with the district court the next business day. The court\n\nclerk shall receive the petition upon delivery by the peace officer\n\nand document the hearing date and time assigned to the case as\n\ndocumented by the peace officer. If the court clerk observes that\n\nservice has not been obtained, the petition shall still be filed by\n\nthe court clerk and issued to the appropriate office of the county\n\nsheriff to obtain service with priority.\n\nD. If an action for divorce, separate maintenance,\n\nguardianship, adoption or any other proceeding involving custody or\n\nvisitation has been filed and is pending in a county different than\n\nthe county in which the emergency ex parte order was issued, the\n\nhearing on the petition for a final protective order shall be\n\ntransferred and held in the same county in which the action for\n\ndivorce, separate maintenance, guardianship, adoption or any other\n\nproceeding involving custody or visitation is pending.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f8bfe83102c5094cf0cc49e1338e5fde55e9f754458a6773de9c8fe83cbf370f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-60.29","next":"us-ok/okla.-stat.-tit.-22-22-60.30"},"notice":"GroundRules: Original legal text.
