Pursuant to paragraph 7 of Section 196 of this title, a\n\npeace officer, without a warrant, shall arrest and take into custody\n\na person if the peace officer has reasonable cause to believe that:\n\n1. An emergency ex parte or final protective order has been\n\nissued and served upon the person, pursuant to the Protection from\n\nDomestic Abuse Act;\n\n2. A true copy and proof of service of the order has been filed\n\nwith the law enforcement agency having jurisdiction of the area in\n\nwhich the plaintiff or any family or household member named in the\n\norder resides or a certified copy of the order and proof of service\n\nis presented to the peace officer as provided in subsection D of\n\nthis section;\n\n3. The person named in the order has received notice of the\n\norder and has had a reasonable time to comply with such order; and\n\n4. The person named in the order has violated the order or is\n\nthen acting in violation of the order.\n\nB. A peace officer, without a warrant, shall arrest and take\n\ninto custody a person if the following conditions have been met:\n\n1. The peace officer has reasonable cause to believe that a\n\nforeign protective order has been issued, pursuant to the law of the\n\nstate or tribal court where the foreign protective order was issued;\n\n2. A certified copy of the foreign protective order has been\n\npresented to the peace officer that appears valid on its face; and\n\n3. The peace officer has reasonable cause to believe the person\n\nnamed in the order has violated the order or is then acting in\n\nviolation of the order.\n\nC. A person arrested pursuant to this section shall be brought\n\nbefore the court within twenty-four (24) hours after arrest to\n\nanswer to a charge for violation of the order pursuant to Section\n\n60.8 of this title, at which time the court shall do each of the\n\nfollowing:\n\n1. Set a time certain for a hearing on the alleged violation of\n\nthe order within seventy-two (72) hours after arrest, unless\n\nextended by the court on the motion of the arrested person;\n\n2. Set a reasonable bond pending a hearing of the alleged\n\nviolation of the order; and\n\n3. Notify the party who has procured the order and direct the\n\nparty to appear at the hearing and give evidence on the charge.\n\nThe court may also consider the safety of any and all alleged\n\nvictims that are subject to the protection of the order prior to the\n\ncourt setting a reasonable bond pending a hearing of the alleged\n\nviolation of the order.\n\nD. A copy of a protective order shall be prima facie evidence\n\nthat such order is valid in this state when such documentation is\n\npresented to a law enforcement officer by the plaintiff, defendant,\n\nor another person on behalf of a person named in the order. Any law\n\nenforcement officer may rely on such evidence to make an arrest for\n\na violation of such order, if there is reason to believe the\n\ndefendant has violated or is then acting in violation of the order\n\nwithout justifiable excuse. When a law enforcement officer relies\n\nupon the evidence specified in this subsection, such officer and the\n\nemploying agency shall be immune from liability for the arrest of\n\nthe defendant if it is later proved that the evidence was false.\n\nE. Any person who knowingly and willfully presents any false or\n\nmaterially altered protective order to any law enforcement officer\n\nto effect an arrest of any person shall, upon conviction, be guilty\n\nof a felony punishable by imprisonment in the custody of the\n\nDepartment of Corrections for a period not to exceed two (2) years,\n\nor by a fine not exceeding Five Thousand Dollars ($5,000.00) and\n\nshall, in addition, be liable for any civil damages to the\n\ndefendant.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"141db487276152250973616906bacde982e5ad9f5cfa2723fcc9807095cd4a14","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-60.8","next":"us-ok/okla.-stat.-tit.-22-22-600"},"notice":"GroundRules: Original legal text.
