A judge of a state court of record in another state, which\n\nby its laws has made provision for commanding persons confined in\n\npenal institutions within that state to attend and testify in this\n\nstate, may certify as follows:\n\n1. There is a criminal proceeding or investigation by a grand\n\njury or other criminal proceeding pending in the court;\n\n2. A person who is confined in a penal institution in this\n\nstate may be a material witness in the proceeding; and\n\n3. His presence will be required during a specified time.\n\nB. Upon presentation of the certificate to any judge having\n\njurisdiction over the person confined and on notice to the attorney\n\ngeneral, the judge in this state shall:\n\n1. Fix a time and place for a hearing; and\n\n2.
