Stat. tit. 22, § 22-731","heading":"Transfer order - Determinations necessary - Copy of","body":"certificate attached - Directions and prescriptions -\n\nResponsibilities of requesting jurisdiction.\n\nA. A judge may issue a transfer order if, at the hearing, the\n\njudge determines as follows:\n\n1. The witness may be material and necessary to the proceeding;\n\n2. His attendance and testimony are not adverse to the interest\n\nof this state or to the health or legal rights of the witness;\n\n3. The laws of the state in which he is requested to testify\n\nwill give him protection from arrest and the service of civil and\n\ncriminal process due to any act committed prior to his arrival in\n\nthe state under the order; and\n\n4. The possibility is negligible that the witness may be\n\nsubject to arrest or to the service of civil or criminal process in\n\nany state through which he will be required to pass.\n\nB. If a judge issues an order under subsection A of this\n\nsection, the judge shall attach to the order a copy of the\n\ncertificate presented pursuant to Section 3 of this act. The order\n\nshall:\n\n1. Direct the witness to attend and testify;\n\n2. Except as provided by subsection C of this section, direct\n\nthe person having custody of the witness to produce him in the court\n\nwhere the criminal proceeding is pending or where the grand jury is\n\nsitting at a time and place specified in the order; and\n\n3. Prescribe such other conditions as the judge shall\n\ndetermine.\n\nC. The judge, in lieu of directing the person having custody of\n\nthe witness to produce him in the requesting jurisdiction's court,\n\nmay direct and require in the order as follows: 1. An officer of\n\nthe requesting jurisdiction to come to the Oklahoma penal\n\ninstitution in which the witness is confined to accept custody of\n\nthe witness for physical transfer to the requesting jurisdiction;\n\n2. The requesting jurisdiction provide proper safeguards for\n\nhis custody while in transit;\n\n3. The requesting jurisdiction be liable for and pay all\n\nexpense incurred in producing and returning the witness, including\n\nbut not limited to food, lodging, clothing, and medical care; and\n\n4.
