If a person confined in a penal institution in any other\n\nstate may be a material witness in a criminal proceeding pending in\n\na court of record or in a grand jury investigation in this state, a\n\njudge of the court may certify as follows:\n\n1. There is a grand jury or a criminal proceeding pending in\n\nthis court;\n\n2. A person who is confined in a penal institution in the other\n\nstate may be a material witness in the proceeding or investigation;\n\nand\n\n3. His presence will be required during a specified time.\n\nB. The judge of the court in this state shall:\n\n1. Present the certificate to a judge of a court of record in\n\nthe other state having jurisdiction over the prisoner confined; and\n\n2.
