The nature of the offense charged.\n\nSecond. The state of the proceedings in the action.\n\nThird. The name and residence of the witness, and that his\n\ntestimony is material to the defense of the action.\n\nFourth. That the witness is about to leave the state, or is so\n\nsick or infirm as to afford reasonable grounds for apprehending that\n\nhe will not be able to attend the trial, or that the magistrate\n\nterminated the preliminary hearing pursuant to Section 258 of this\n\ntitle and that the witness refuses to grant an interview to counsel\n\nregarding the material issues for trial.\n\nR.L. 1910, § 6027.
