Stat. tit. 22, § 22-769","heading":"Taking and authentication of testimony","body":"The testimony given by the witness must be reduced to writing.\n\nThe magistrate before whom the examination is had may, in his\n\ndiscretion, order the testimony and proceedings to be taken down in\n\nshorthand, and for that purpose he may appoint a shorthand reporter.\n\nThe deposition or testimony of the witness must be authenticated in\n\nthe following form:\n\n1. It must state the name of the witness, his place of\n\nresidence and his business or profession.\n\n2. It must contain the questions put to the witness and his\n\nanswers thereto, each answer being distinctly read to him as it is\n\ntaken down, and being corrected or added to until it conforms to\n\nwhat he declares is the truth; except in cases where the testimony\n\nis taken down in shorthand, the answer or answers of the witness\n\nneed not be read to him.\n\n3. If the witness declines answering a question, that fact with\n\nthe ground on which the answer was declined must be stated.\n\n4. The deposition must be signed by the witness, or if he\n\nrefuse to sign it, his reason for refusing must be stated in writing\n\nas he gives it; except in cases where the deposition is taken down\n\nin shorthand, it must not be signed by the witness.\n\n5. It must be signed and certified by the magistrate when\n\nreduced to writing by him or under his direction; and when taken\n\ndown in shorthand, the manuscript of the reporter, appointed as\n\naforesaid, when written out in longhand writing, and certified as\n\nbeing a correct statement of such testimony and proceedings in the\n\ncase, shall be prima facie a correct statement of such testimony and\n\nproceedings.
