Each fiscal year the Division, in collaboration with the\n\nlocal planning councils, shall provide goals and funding priorities\n\nfor community punishments as provided by law. The statewide\n\ncommunity sentencing system shall be composed of local community\n\nsentencing system plans as approved by the Division. The Division\n\nshall promulgate rules for local community sentencing systems based\n\nupon objective criteria for allocation of state-appropriated funds\n\nto local systems for day-to-day operation during a fiscal year which\n\nmay include identification of:\n\n1. Fiscally responsible allocations of services and funds;\n\n2. Innovative or effective programs of the local system; and\n\n3. Appropriate targeting of offenders for services.\n\nThe Division and each of the local community sentencing systems are\n\nrequired to operate within the appropriated funds. The state shall\n\nrequire each local community sentencing system to identify resources\n\nother than state funds as part of the funding formula. The Division\n\nshall establish procedures for disbursement of state funds to\n\nservice providers, and shall disburse state funds in a timely\n\nmanner.\n\nB. For a local community sentencing system to remain eligible\n\nfor state funding, a local community sentencing system shall:\n\n1. Demonstrate fiscal responsibility by operating the local\n\nsystem within the plan and budget allocation;\n\n2. Require performance-based selection of service providers\n\nparticipating in the annual system plan;\n\n3. Submit a plan which offers a continuum of sanctions for\n\neligible offenders sentenced to the local community sentencing\n\nsystem and appropriately assign offenders for services; and\n\n4. Comply with the rules promulgated by the Community\n\nSentencing Division within the Department of Corrections and the\n\nprovisions of the Oklahoma Community Sentencing Act.\n\nC. When state funding is required to implement a local\n\ncommunity sentencing system plan, the Community Sentencing Division\n\nshall approve the plan only to the extent that the jurisdiction's\n\nshare of the total state appropriations will support the\n\nimplementation of the local system plan. Modification to a local\n\nplan shall be for budgetary purposes, as provided in Section 988.7\n\nof this title, and for compliance with law and rule.\n\nD. State funds from the Community Sentencing Division disbursed\n\nto community sentencing systems shall be used for operation and\n\nadministrative expenses and shall not be used to construct,\n\nrenovate, remodel, expand or improve any jail, residential treatment\n\nfacility, restrictive housing facility, or any other structure, nor\n\nshall these funds be used to replace funding or other resources from\n\nthe federal, state, county or city government committed in support\n\nof the detailed system plan during the plan year.\n\nE. Any funds accruing to the benefit of a community sentencing\n\nsystem shall be deposited in the Oklahoma Community Sentencing\n\nRevolving Fund created as provided in Section 557.1 of Title 57 of\n\nthe Oklahoma Statutes, and shall be credited to the local\n\njurisdiction making such deposit. The Community Sentencing Division\n\nwithin the Department of Corrections and every local planning\n\ncouncil are authorized to apply for and accept grants, gifts,\n\nbequests and other lawful money from nonprofit private\n\norganizations, for-profit organizations, political subdivisions of\n\nthis state, the United States, and private citizens to support or\n\nexpand the community sentencing system.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"64e1a494f44d7f9984cc4797a60a2c70fa477043e8310a7dd6fda113d8b29613","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-988.15","next":"us-ok/okla.-stat.-tit.-22-22-988.17"},"notice":"GroundRules: Original legal text.
