A detailed plan for each local community sentencing system\n\nseeking state funds shall be submitted each fiscal year to the\n\nCommunity Sentencing Division within the Department of Corrections\n\npursuant to the rules promulgated for such purpose. The designated\n\njudge of the planning council shall review the range of services\n\nproposed in the plan and declare in writing whether the proposed\n\nservices meet the needs of the court for purposes of sentencing\n\npursuant to the authority of the Oklahoma Community Sentencing Act.\n\nThe judge shall forward the plan to the Division for state review\n\nand appropriate funding. A plan that conforms with the purposes and\n\ngoals of the Oklahoma Community Sentencing Act shall not be modified\n\nor disapproved except when the plan requires more funding than is\n\navailable to the local system. Each local community sentencing\n\nsystem plan shall include, but not be limited to, the following\n\ngoals:\n\n1. Identification of existing resources, including cash,\n\nprofessional services, in-kind resources, property, or other sources\n\nof resources;\n\n2. Identification of additional resources needed, identified by\n\ntype and amount;\n\n3. Projected number of offenders to be served by each provider\n\nand the projected total number of offenders to be served by the\n\nlocal system;\n\n4. Types and priority groups of offenders to be served for\n\npurposes of budgeting and targeting specific use of selected service\n\nproviders;\n\n5. Identification of sentencing practices used for disciplinary\n\nsanctions for noncriminal conduct against participating offenders\n\nand applicable costs;\n\n6. Identification of local policy statements;\n\n7. Methods for allocating resources to support the services\n\nincluded in the plan;\n\n8. Identification and evaluation of local record keeping and\n\nneeds for audits or reviews;\n\n9. Identification of any special administrative structure of\n\nthe local system and list of specific service providers\n\nparticipating in the system, including detailed qualifications of\n\nstaff and program administrators; and\n\n10. Description and evaluation of the extent of community\n\nparticipation and support for the local system.\n\nB. A community sentencing system shall be operational when the\n\nplan is accepted by the Community Sentencing Division or is\n\nreceiving funding. The Division, upon receipt of a proposed local\n\nsystem plan for conformance with the purpose and goals of the\n\nOklahoma Community Sentencing Act, shall have not more than forty-\n\nfive (45) days to evaluate the plan and to notify the planning\n\ncouncil of any recommended modification. The Division shall notify\n\nthe chair of each local community sentencing system of its allocated\n\nbudget by June 15. Based on the funding allocation, the local\n\ncommunity sentencing system shall submit its budget to the Division\n\nprior to finalizing provider service agreements for the fiscal year.\n\nThe Division shall not restrict by rule or practice the plan of any\n\nlocal system or determine what constitutes treatment or necessary\n\nservices if the treatment or services comply with the purposes and\n\ngoals of the Oklahoma Community Sentencing Act, unless there is a\n\ndemonstrated deficiency or poor program evaluation.\n\nC. A local administrator as provided in Section 988.13 of this\n\ntitle shall assist the local planning council in gathering and\n\nkeeping accurate information about the jurisdiction to support the\n\nplanning process. For the previous two (2) years, the information\n\npertaining to the jurisdiction may include, but not be limited to:\n\n1. The number and rate of arrests, number of convictions,\n\nadmissions to probation, number of offenders sentenced to post-\n\nimprisonment supervision, number of offenders sentenced to county\n\njail, average length of sentence served in county jail, number of\n\noffenders sentenced to the custody of the Department of Corrections,\ntion\n\npertaining to the jurisdiction may include, but not be limited to:\n\n1. The number and rate of arrests, number of convictions,\n\nadmissions to probation, number of offenders sentenced to post-\n\nimprisonment supervision, number of offenders sentenced to county\n\njail, average length of sentence served in county jail, number of\n\noffenders sentenced to the custody of the Department of Corrections,\n\nand average length of sentence served in the custody of the\n\nDepartment of Corrections;\n\n2. Current jail capacity, and jail population data by offender-\n\ntype including, but not limited to, misdemeanor, felony, trusty,\n\npost-trial detainee, pretrial detainee, disciplinary sanction or\n\njuvenile;\n\n3. A listing of services and programs available in the\n\ncommunity, including costs, space availability, the number of\n\noffenders participating, the average length of participation and\n\nperformance-based data;\n\n4. Range of community punishments previously used by the courts\n\nfor offenders within the jurisdiction, including methods and use of\n\ndisciplinary sanctions for noncriminal behavior of offenders\n\nsentenced to community punishment and use of incentives;\n\n5. A listing of educational, vocational-technical, health,\n\nmental health, substance abuse treatment, medical, and social\n\nservices available to offenders or to be made available within a\n\ntwelve-month period;\n\n6. Restrictive residential facilities or other restrictive\n\nhousing options available or to be made available within a twelve-\n\nmonth period; and\n\n7.
