A community sentencing system established pursuant to the\n\nprovisions of the Oklahoma Community Sentencing Act shall include\n\nthose community punishments and programs and services enumerated and\n\nfunded in the annual plan submitted to the Community Sentencing\n\nDivision within the Department of Corrections and any other services\n\nor punishments subsequently added and funded during a plan year.\n\nThe options may not be utilized for offenders not meeting the\n\neligibility criteria of programs and score requirements for the risk\n\nand needs assessment. Each local system shall strive to have\n\navailable to the court all of the following services for eligible\n\noffenders:\n\n1. Community service with or without compensation to the\n\noffender;\n\n2. Substance abuse treatment and availability for periodic drug\n\ntesting of offenders following treatment;\n\n3. Varying levels of supervision by the Department of\n\nCorrections probation officers or another qualified supervision\n\nsource, including specialized supervision for repeat offenders,\n\noffenders with convictions for sex crimes, offenders with conviction\n\nfor domestic violence offenses and offenders with diagnosed mental\n\nhealth needs;\n\n4. Education and literacy provided by the State Department of\n\nEducation, the county library system, the local school board, or\n\nanother qualified source;\n\n5. Employment opportunities and job skills training provided by\n\nthe Oklahoma Department of Career and Technology Education or\n\nanother qualified source;\n\n6. Cognitive behavioral treatment and any other programming or\n\ntreatment needs as identified based on the results of the risk and\n\nneeds assessment administered under this section;\n\n7. Enforced collections provided by the local court clerk, or\n\nanother state agency; and\n\n8. The availability of county jail or another restrictive\n\nhousing facility for limited disciplinary sanctions.\n\nB. The court may order as a community punishment for an\n\neligible offender any condition listed as a condition available for\n\na suspended sentence.\n\nC. In all cases in which an offender is sentenced to a\n\ncommunity punishment, the offender shall be ordered as part of the\n\nterms and conditions of the sentence to pay for the court ordered\n\nsanction, based upon ability to pay. Payments may be as provided by\n\ncourt order or pursuant to periodic payment schedules established by\n\nthe service provider.
