Stat. tit. 22, § 22-991a-17","heading":"Enhancement of sentence","body":"Whenever a person is convicted of an offense enumerated in\n\nSection 445 of this act in which the victim is elderly or\n\nincapacitated, the court shall upon conviction:\n\n1. Commit the defendant for confinement as provided by law;\n\nprovided, the first thirty (30) days of the sentence shall not be\n\nsubject to probation, suspension or deferral; provided further, this\n\nmandatory minimum period of confinement shall be served in the\n\ncounty jail as a condition of a suspended or deferred sentence,\n\npursuant to Section 991a of Title 22 of the Oklahoma Statutes and\n\nmay be served by night or weekend incarceration pursuant to Section\n\n991a-2 of Title 22 of the Oklahoma Statutes; and\n\n2. a. Require restitution be paid to the victim for out-of-\n\npocket expenses, loss or damage to property and\n\nmedical expenses for injury proximately caused by the\n\nconduct of the defendant pursuant to Section 447 of\n\nthis act, or\n\nb. Assign the offender to perform a required term of\n\ncommunity service, according to a schedule consistent\n\nwith the employment and family responsibility of the\n\nperson convicted, or\n\nc. Require restitution as provided in subparagraph a of\n\nthis paragraph and community service as provided in\n\nsubparagraph b of this paragraph; and\n\n3.
