Every person who, having been convicted of any offense\n\nagainst an elderly or incapacitated person, as enumerated in Section\n\n445 of this act, commits any crime against an elderly or\n\nincapacitated person after such conviction is punishable as follows:\n\n1. If the offense of which such person is subsequently\n\nconvicted is such that upon a first conviction an offender would be\n\npunishable by imprisonment in the State Penitentiary for any term\n\nexceeding five (5) years, such person is punishable by imprisonment\n\nin the State Penitentiary for a term not less than ten (10) years;\n\nor\n\n2. If such subsequent offense is such that upon a first\n\nconviction the offender would be punishable by imprisonment in the\n\nState Penitentiary for five (5) years or less, then the person\n\nconvicted of such subsequent offense is punishable by imprisonment\n\nin the State Penitentiary for a term not exceeding fifteen (15)\n\nyears.\n\nB. Every person who, having been twice convicted of felony\n\noffenses against an elderly or incapacitated person, commits a third\n\nfelony offense against an elderly or incapacitated person within ten\n\n(10) years of the date following the completion of the execution of\n\nthe first sentence, shall be punishable by imprisonment in the State\n\nPenitentiary for a term of not less than twenty (20) years.\n\nC. All felony offenses arising out of the same transaction or\n\noccurrence or series of events closely related in time and location\n\nshall be considered as one offense for the purposes of this section.\n\nD.
