When the court orders supervision by the Department of\n\nCorrections, or the district attorney requires the Department to\n\nsupervise any person pursuant to a deferred prosecution agreement,\n\nthe person shall be required to pay a supervision fee of Forty\n\nDollars ($40.00) per month during the supervision period, unless the\n\nfee would impose an unnecessary hardship on the person. In hardship\n\ncases, the Department shall expressly waive all or part of the fee.\n\nThe court shall make payment of the fee a condition of the sentence\n\nwhich shall be imposed whether the supervision is incident to the\n\nsuspending of execution of a sentence, incident to the suspending of\n\nimposition of a sentence, or incident to the deferral of proceedings\n\nafter a verdict or plea of guilty. The Department shall determine\n\nmethods for payment of supervision fee, and may charge a reasonable\n\nuser fee for collection of supervision fees electronically. The\n\nDepartment is required to report to the sentencing court any failure\n\nof the person to pay supervision fees and to report immediately if\n\nthe person violates any condition of the sentence.\n\n2. When the court imposes a suspended or deferred sentence for\n\nany offense and does not order supervision by the Department of\n\nCorrections, the offender shall be required to pay to the district\n\nattorney a supervision fee of Forty Dollars ($40.00) per month as a\n\nfee to compensate the district attorney for the actual act of\n\nsupervising the offender during the applicable period of\n\nsupervision. In hardship cases, the district attorney shall\n\nexpressly waive all or part of the fee. Any fees collected by the\n\ndistrict attorney pursuant to this paragraph shall be deposited in\n\nthe General Revenue Fund of the State Treasury.\n\n3. If restitution is ordered by the court in conjunction with\n\nsupervision, the supervision fee will be paid in addition to the\n\nrestitution ordered. In addition to the restitution payment and\n\nsupervision fee, a reasonable user fee may be charged by the\n\nDepartment of Corrections to cover the expenses of administration of\n\nthe restitution, except no user fee shall be collected by the\n\nDepartment when restitution payment is collected and disbursed to\n\nthe victim by the office of the district attorney as provided in\n\nSection 991f of this title or Section 991f-1.1 of this title.\n\nB. The Pardon and Parole Board shall require a supervision fee\n\nto be paid by the parolee as a condition of parole which shall be\n\npaid to the Department of Corrections. The Department shall\n\ndetermine the amount of the fee as provided for other persons under\n\nsupervision by the Department.\n\nC. Upon acceptance of an offender by the Department of\n\nCorrections whose probation or parole supervision was transferred to\n\nOklahoma through the Interstate Compact Agreement, or upon the\n\nassignment of an inmate to any community placement, a fee shall be\n\nrequired to be paid by the offender to the Department of Corrections\n\nas provided for other persons under supervision of the Department.\n\nD. Except as provided in subsection A and this subsection, all\n\nfees collected pursuant to this section shall be deposited in the\n\nDepartment of Corrections Revolving Fund created pursuant to Section\n\n557 of Title 57 of the Oklahoma Statutes. For the fiscal year\n\nending June 30, 1996, fifty percent (50%) of all collections\n\nreceived from offenders placed on supervision after July 1, 1995,\n\nshall be transferred to the credit of the General Revenue Fund of\n\nthe State Treasury until such time as total transfers equal Three\n\nMillion Three Hundred Thousand Dollars ($3,300,000.00).","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"047536535981e29c3b3234926b7644455dd92c0ba0b39cf770f286e8ef96569e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-991c","next":"us-ok/okla.-stat.-tit.-22-22-991f"},"notice":"GroundRules: Original legal text.
