Stat. tit. 23, § 23-103","heading":"Actions asserted in bad faith - Reimbursement by","body":"nonprevailing party of costs and fees.\n\nIn any action for damages for personal injury except injury\n\nresulting in death, or in any action for damages to personal rights\n\nthe court shall, subsequent to adjudication on the merits and upon\n\nmotion of the prevailing party, determine whether a claim or defense\n\nasserted in the action by a nonprevailing party was asserted in bad\n\nfaith, was not well grounded in fact, or was unwarranted by existing\n\nlaw or a good faith argument for the extension, modification, or\n\nreversal of existing law.
