For wrongful injuries to timber upon the land of another, or\n\nremoval thereof, the measure of damages is not less than three (3)\n\ntimes nor more than ten (10) times such a sum as would compensate\n\nfor the actual detriment, unless:\n\n1. The trespass was casual and involuntary;\n\n2. Committed under the belief that the timber or land belonged\n\nto the trespasser; or\n\n3. The timber was taken by the authority of highway officers\n\nfor the purposes of a highway,\n\nin which case the damages are a sum equal to the actual detriment.\n\nB. The prevailing party shall be entitled to costs and\n\nattorneys fees.\n\nC. For purposes of this section, the term \"timber\" shall be\n\ndefined as the term is defined by Section 1301-102 of Title 2 of the\n\nOklahoma Statutes.\n\nR.L. 1910, § 2883.
