A transfer made or obligation incurred by a debtor is\n\nfraudulent as to a creditor, whether the creditor's claim arose\n\nbefore or after the transfer was made or the obligation was\n\nincurred, if the debtor made the transfer or incurred the\n\nobligation:\n\n1. With actual intent to hinder, delay, or defraud any creditor\n\nof the debtor; or\n\n2. Without receiving a reasonably equivalent value in exchange\n\nfor the transfer or obligation, and the debtor:\n\na. was engaged or was about to engage in a business or a\n\ntransaction for which the remaining assets of the\n\ndebtor were unreasonably small in relation to the\n\nbusiness or transaction, or\n\nb. intended to incur, or believed or reasonably should\n\nhave believed that he would incur, debts beyond his\n\nability to pay as they became due.\n\nB. In determining actual intent pursuant to the provisions of\n\nparagraph 1 of subsection A of this section, consideration may be\n\ngiven, among other factors, to whether:\n\n1. The transfer or obligation was to an insider;\n\n2. The debtor retained possession or control of the property\n\ntransferred after the transfer;\n\n3. The transfer or obligation was disclosed or concealed;\n\n4. Before the transfer was made or obligation was incurred, the\n\ndebtor had been sued or threatened with suit;\n\n5. The transfer was of substantially all the debtor's assets;\n\n6. The debtor absconded;\n\n7. The debtor removed or concealed assets;\n\n8. The value of the consideration received by the debtor was\n\nreasonably equivalent to the value of the asset transferred or the\n\namount of the obligation incurred;\n\n9. The debtor was insolvent or became insolvent shortly after\n\nthe transfer was made or the obligation was incurred;\n\n10. The transfer occurred shortly before or shortly after a\n\nsubstantial debt was incurred; and\n\n11.
