Stat. tit. 24, § 24-118","heading":"Tests for determining when transfer is made or obligation","body":"incurred.\n\nFor the purposes of the Uniform Fraudulent Transfer Act:\n\n1. A transfer is made:\n\na. with respect to an asset that is real property other\n\nthan a fixture, but including the interest of a seller\n\nor purchaser under a contract for the sale of the\n\nasset, when the transfer is so far perfected that a\n\ngood-faith purchaser of the asset from the debtor\n\nagainst whom applicable law permits the transfer to be\n\nperfected cannot acquire an interest in the asset that\n\nis superior to the interest of the transferee; and\n\nb. with respect to an asset that is not real property or\n\nthat is a fixture, when the transfer is so far\n\nperfected that a creditor on a simple contract cannot\n\nacquire a judicial lien otherwise than in accordance\n\nwith the provisions of the Uniform Fraudulent Transfer\n\nAct that is superior to the interest of the\n\ntransferee.\n\n2. If applicable law permits the transfer to be perfected as\n\nprovided for in paragraph 1 of this section and the transfer is not\n\nso perfected before the commencement of an action for relief\n\npursuant to the provisions of the Uniform Fraudulent Transfer Act,\n\nthe transfer is deemed made immediately before the commencement of\n\nthe action.\n\n3. If applicable law does not permit the transfer to be\n\nperfected as provided for in paragraph 1 of this section, the\n\ntransfer is made when it becomes effective between the debtor and\n\nthe transferee.\n\n4. A transfer is not made until the debtor has acquired rights\n\nin the asset transferred.\n\n5.
