Stat. tit. 25, § 25-1301","heading":"Definitions","body":"As used in Section 1101 et seq. of this title:\n\n1. \"Employer\" means:\n\na. a legal entity, institution or organization that pays\n\none or more individuals a salary or wages for work\n\nperformance, or\n\nb. a legal entity, institution or organization which\n\ncontracts or subcontracts with the state, a\n\ngovernmental entity or a state agency to furnish\n\nmaterial or perform work.\n\nEmployer does not include a Native American tribe or a bona fide\n\nmembership club, other than a labor organization, that is exempt\n\nfrom taxation under Title 26, Section 501(c) of the United States\n\nCode;\n\n2. \"Employment agency\" means a person regularly undertaking\n\nwith or without compensation to procure employees for an employer or\n\nto procure for employees opportunities to work for an employer and\n\nincludes an agent of such a person;\n\n3. \"Labor organization\" means:\n\na. an organization of any kind, an agency or employee\n\nrepresentation committee, group, association, or plan\n\nin which employees participate and which exists for\n\nthe purpose, in whole or in part, of dealing with\n\nemployers concerning grievances, labor disputes,\n\nwages, rates of pay, hours, or other terms or\n\nconditions of employment,\n\nb. a conference, general committee, joint or system\n\nboard, or joint council so engaged which is\n\nsubordinate to a national or international labor\n\norganization, or\n\nc. an agent of a labor organization;\n\n4. “Individual with a disability” means a person who has a\n\nphysical or mental impairment which substantially limits one or more\n\nof such person's major life activities, has a record of such an\n\nimpairment or is regarded as having such an impairment;\n\n5. \"Age discrimination in employment\" means discrimination in\n\nemployment of persons who are at least forty (40) years of age;\n\n6. “Sex”, “because of sex” or “based on sex” includes, but is\n\nnot limited to, pregnancy, childbirth or related medical conditions;\n\nwomen affected by pregnancy, childbirth or related medical\n\nconditions shall be treated the same for all employment-related\n\npurposes as other persons not so affected but similar in their\n\nability or inability to work;\n\n7. “Genetic information” means information derived from the\n\nresults of a genetic test. “Genetic information” shall not include\n\nfamily history, the results of a routine physical examination or\n\ntest, the results of a chemical, blood or urine analysis, the\n\nresults of a test to determine drug use, the results of a test for\n\nthe presence of the human immunodeficiency virus, or the results of\n\nany other test commonly accepted in clinical practice at the time it\n\nis ordered; and\n\n8. “Employee” means an individual who receives a salary or\n\nwages from an employer.
