Stat. tit. 25, § 25-1309","heading":"Seniority and merit systems - Compulsory retirement","body":"Notwithstanding any other provision of Section 1101 et seq. of\n\nthis title, it is not a discriminatory practice for an employer:\n\n1. To apply different standards of compensation or different\n\nterms, conditions, privileges, or responsibilities of employment\n\npursuant to a bona fide seniority or merit system, or a system which\n\nmeasures earnings by quantity or quality of production or to\n\nemployees who work in different locations, if the differences are\n\nnot the result of an intention to discriminate because of race,\n\ncolor, religion, sex, national origin, age, disability, or genetic\n\ninformation; or\n\n2. To give and to act upon the results of a professionally-\n\ndeveloped ability test if the test, its administration, or action\n\nupon the results is not designed, intended, or used to discriminate\n\nbecause of race, color, religion, sex, national origin, age,\n\ndisability, or genetic information.\n\n3. To require the compulsory retirement of any person who has\n\nattained the age of sixty-five (65) and who, for the two-year period\n\nimmediately before retirement, is employed in a bona fide executive\n\nor high policymaking position, if such person is entitled to an\n\nimmediate nonforfeitable annual retirement benefit from a pension,\n\nprofit-sharing, savings or deferred compensation plan, or any\n\ncombination of such plans, of the employer, which equals, in the\n\naggregate, at least Forty-four Thousand Dollars ($44,000.00).","path":["OK Code","Title 25"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os25.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e1b1b50940db0e76f2eba5348790e89f70e424457daff4bb1f89ddc362f1779e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-25-25-1308","next":"us-ok/okla.-stat.-tit.-25-25-1310"},"notice":"GroundRules: Original legal text.
