Stat. tit. 25, § 25-1310","heading":"Imbalance","body":"Nothing contained in Section 1101 et seq. of this title requires\n\nan employer, employment agency, labor organization, or joint labor-\n\nmanagement committee subject to Section 1101 et seq. of this title\n\nto grant preferential treatment to an individual or to a group\n\nbecause of race, color, religion, sex, national origin, age,\n\ndisability, or genetic information of the individual or group on\n\naccount of an imbalance which may exist with respect to the total\n\nnumber or percentage of persons of any race, color, religion, sex,\n\nnational origin, age, disability, or genetic information employed by\n\nan employer, referred or classified for employment by an employment\n\nagency or labor organization, admitted to membership or classified\n\nby a labor organization, or admitted to, or employed in, an\n\napprenticeship, or other training or retraining program, in\n\ncomparison with the total number or percentage of persons of the\n\nrace, color, religion, sex, national origin, age, disability, or\n\ngenetic information in the state or a community, section, or other\n\narea, or in the available work force in the state or a community,\n\nsection, or other area.
