Stat. tit. 25, § 25-1350","heading":"Employment based discrimination - Cause of action -","body":"Remedies - Procedure.\n\nA. A cause of action for employment-based discrimination is\n\nhereby created and any common law remedies are hereby abolished.\n\nB. In order to have standing in a court of law to allege\n\ndiscrimination arising from an employment-related matter, in a cause\n\nof action against an employer for discrimination based on race,\n\ncolor, religion, sex, national origin, age, disability, genetic\n\ninformation with respect to the employee, or retaliation, an\n\naggrieved party must, within one hundred eighty (180) days from the\n\nlast date of alleged discrimination, file a charge of discrimination\n\nin employment with the Attorney General's Office of Civil Rights\n\nEnforcement or the Equal Employment Opportunity Commission alleging\n\nthe basis of discrimination believed to have been perpetrated on the\n\naggrieved party. Upon completion of any investigation, the Attorney\n\nGeneral's Office of Civil Rights Enforcement may transmit the\n\nresults of any administrative hearing and determination to the Equal\n\nEmployment Opportunity Commission or issue the complaining party a\n\nNotice of a Right to Sue.\n\nC. Should a charge of discrimination be filed with the Attorney\n\nGeneral's Office of Civil Rights Enforcement and not be resolved to\n\nthe satisfaction of the charging party within one hundred eighty\n\n(180) days from the date of filing of such charge, the Attorney\n\nGeneral's Office of Civil Rights Enforcement, upon request of any\n\nparty shall issue a Notice of a Right to Sue, which must be first\n\nobtained in order to commence a civil action under this section.\n\nD. All civil actions brought pursuant to a Notice of a Right to\n\nSue from the Attorney General's Office of Civil Rights Enforcement\n\nfor redress against any person who is alleged to have discriminated\n\nagainst the charging party and against any person named as\n\nrespondent in the charge shall be commenced in the district court of\n\nthis state for the county in which the unlawful employment practice\n\nis alleged to have been committed.\n\nE. Either party in any such action shall be entitled to a jury\n\ntrial of any facts in dispute in the action.\n\nF. The defending party may allege any defense that is available\n\nunder Title VII of the Civil Rights Act of 1964, the Age\n\nDiscrimination in Employment Act, the Pregnancy Discrimination Act,\n\nthe Rehabilitation Act, the Americans with Disabilities Act, or the\n\nGenetic Information Nondiscrimination Act.\n\nG. If it is determined in such action that the defendant or\n\ndefendants in such action have discriminated against the charging\n\nparty as charged in the petition, the court may enjoin the defendant\n\nor defendants from engaging in such unlawful employment practice\n\ncharged in the petition, the court may enjoin respondent from\n\nengaging in such unlawful practice and order such affirmative action\n\nas reinstatement or hiring of employees. A prevailing aggrieved\n\nparty shall also be entitled to backpay and an additional amount as\n\nliquidated damages. Interim earnings or amounts earnable with\n\nreasonable diligence by the person discriminated against shall\n\noperate to reduce the backpay otherwise allowable. If an individual\n\nwas refused employment or advancement, was suspended and/or was\n\ndischarged for legitimate reasons other than discrimination as\n\nprovided by this act, then no order of the court shall require the\n\nhiring, reinstatement or promotion of that individual as an\n\nemployee, nor shall it order payment of any backpay.\n\nH. In any action or proceeding under this section, the court\n\nmay allow a prevailing plaintiff or defendant a reasonable attorney\n\nfee.\n\nI.
