A public body may hold meetings by videoconference where\n\neach member of the public body is visible and audible to each other\n\nand the public through a video monitor, subject to the following:\n\n1. a. except as provided for in subparagraph b of this\n\nparagraph, no less than a quorum of the public body\n\nshall be present in person at the meeting site as\n\nposted on the meeting notice and agenda,\n\nb. a virtual charter school approved and sponsored by the\n\nStatewide Charter School Board pursuant to the\n\nprovisions of Section 3-132.1 of Title 70 of the\n\nOklahoma Statutes, or the Statewide Independent Living\n\nCouncil established pursuant to Section 625.2 of Title\n\n56 of the Oklahoma Statutes, shall maintain a quorum\n\nof members for the entire duration of the meeting\n\nwhether using an in-person site, videoconference sites\n\nor any combination of such sites to achieve a quorum,\n\nand\n\nc. each public meeting held by videoconference or\n\nteleconference shall be recorded either by written,\n\nelectronic, or other means;\n\n2. The meeting notice and agenda prepared in advance of the\n\nmeeting, as required by law, shall indicate if the meeting will\n\ninclude videoconferencing locations and shall state:\n\na. the location, address, and telephone number of each\n\navailable videoconference site, and\n\nb. the identity of each member of the public body and the\n\nspecific site from which each member of the body shall\n\nbe physically present and participating in the\n\nmeeting;\n\n3. After the meeting notice and agenda are prepared and posted,\n\nas required by law, no member of the public body shall be allowed to\n\nparticipate in the meeting from any location other than the specific\n\nlocation posted on the agenda in advance of the meeting;\n\n4. In order to allow the public the maximum opportunity to\n\nattend and observe each public official carrying out the duties of\n\nthe public official, a member or members of a public body desiring\n\nto participate in a meeting by videoconference shall participate in\n\nthe videoconference from a site and room located within the district\n\nor political subdivision from which they are elected, appointed, or\n\nare sworn to represent;\n\n5. Each site and room where a member of the public body is\n\npresent for a meeting by videoconference shall be open and\n\naccessible to the public, and the public shall be allowed into that\n\nsite and room. Public bodies may provide additional videoconference\n\nsites as a convenience to the public, but additional sites shall not\n\nbe used to exclude or discourage public attendance at any\n\nvideoconference site;\n\n6. The public shall be allowed to participate and speak, as\n\nallowed by rule or policy set by the public body, in a meeting at\n\nthe videoconference site in the same manner and to the same extent\n\nas the public is allowed to participate or speak at the site of the\n\nmeeting;\n\n7. Unless confidential or privileged under applicable law, any\n\nmaterials shared electronically between members of the public body,\n\nbefore or during the videoconference, shall also be immediately\n\navailable to the public in the same form and manner as shared with\n\nmembers of the public body; and\n\n8. All votes occurring during any meeting conducted using\n\nvideoconferencing shall occur and be recorded by roll call vote.\n\nB. Except as provided for in subsections C and D of this\n\nsection, no public body shall conduct an executive session by\n\nvideoconference.\n\nC. The Oklahoma Tax Commission may conduct executive sessions\n\nwith the taxpayer at issue attending using videoconference\n\ntechnology to discuss confidential taxpayer matters as provided for\n\nin Section 205 of Title 68 of the Oklahoma Statutes. During\n\nexecutive sessions, the Commission is required to be physically\n\npresent while taxpayers may appear using videoconference technology.\noconference.\n\nC. The Oklahoma Tax Commission may conduct executive sessions\n\nwith the taxpayer at issue attending using videoconference\n\ntechnology to discuss confidential taxpayer matters as provided for\n\nin Section 205 of Title 68 of the Oklahoma Statutes. During\n\nexecutive sessions, the Commission is required to be physically\n\npresent while taxpayers may appear using videoconference technology.\n\nThe technology selected and utilized by the Commission shall ensure\n\ntaxpayer confidentiality including compliance with safeguards as\n\nprovided for in Internal Revenue Service Publication 1075.\n\nD. The Statewide Independent Living Council established\n\npursuant to Section 625.2 of Title 56 of the Oklahoma Statutes may\n\nconduct executive sessions using videoconference technology. For\n\nsuch executive sessions, no Council member shall be required to be\n\nphysically present as long as each Council member is audible or\n\nvisible to each other. The meeting notice and agenda prepared in\n\nadvance of the meeting as required by law shall indicate if the\n\nexecutive session will include videoconferencing and shall also\n\nstate the identity of each Council member appearing remotely, and\n\nwhether any member will be physically present at the meeting site,\n\nif any, for the executive session.","path":["OK Code","Title 25"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os25.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4c9f2f1d00758006b693a369187103736ec8f1ff89f5a82887de836b738aaf62","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-25-25-307","next":"us-ok/okla.-stat.-tit.-25-25-308"},"notice":"GroundRules: Original legal text.
