For the purposes of this section, “absentee ballot\n\nharvesting” means:\n\n1. Collecting or obtaining an absentee ballot from another\n\nperson with the intent to submit, transmit or return the ballot to\n\nelection officials on behalf of that person;\n\n2. Submitting, returning or transmitting an absentee ballot to\n\nelection officials on behalf of another person;\n\n3. Collecting or obtaining an absentee ballot from another\n\nperson under a false pretense or promise of transmitting, returning\n\nor submitting it to election officials on behalf of that person;\n\n4. Requesting or receiving an absentee ballot on behalf of\n\nanother person;\n\n5. Distributing an absentee ballot application or request to a\n\nvoter using the official letterhead of a candidate or elected\n\nofficial;\n\n6. Partially or fully completing an application for an absentee\n\nballot on behalf of another person without that person’s prior\n\nconsent; or\n\n7. Notarizing or witnessing more absentee ballots than allowed\n\nby law.\n\nB. Absentee ballot harvesting shall be unlawful at any election\n\nconducted by a county election board, the State Election Board or\n\nany political subdivision of this state; provided, the following\n\nshall not be deemed to be ballot harvesting:\n\n1. A voter’s assistant or agent acting pursuant to law as\n\notherwise allowed by this title;\n\n2. An absentee voting board member, as described in this title,\n\nwho assists a voter confined to a nursing home or State Veterans\n\nHome pursuant to law;\n\n3. An employee of the Federal Voting Assistance Program, the\n\nUnited States Department of Defense or the Oklahoma National Guard\n\nwho assists a uniformed-services voter in returning or transmitting\n\nan absentee ballot;\n\n4. A spouse, relative in the first or second degree of\n\nconsanguinity or affinity or cohabitant of a voter who forwards an\n\nabsentee ballot to the voter when absent from the home;\n\n5. A voter’s spouse who, with the voter’s consent, returns the\n\nvoter’s absentee ballot by mail; or\n\n6.
