Stat. tit. 26, § 26-20-104","heading":"Certification of candidates - Allocation of delegates -","body":"Future primaries - Delegate voting.\n\nA. Upon the completion of the state canvass of the results of\n\nthe Presidential Preferential Primary, the Secretary of the State\n\nElection Board shall certify to the state chairman of each political\n\nparty which has candidates participating in the primary:\n\n1. the names of the party's candidates and the votes each\n\nreceived, by congressional district as well as statewide; and\n\n2. the total of the votes cast in the political party, by\n\ncongressional district as well as statewide.\n\nB. Each candidate shall be awarded delegates by congressional\n\ndistricts proportionately, by the ratio of votes they received to\n\nthe total vote cast in said congressional district; provided\n\nhowever, no delegates shall be awarded to any candidate receiving\n\nless than fifteen percent (15%) of the vote, and such votes shall be\n\nallocated among the other candidates in proportion to their total\n\nvote. If no candidate receives fifteen percent (15%) or more of the\n\nvote, then the candidate receiving the highest number of votes in\n\nthat district shall be awarded all the delegates from that district.\n\nC. The candidate receiving the largest number of votes statewide\n\nshall be awarded all delegate votes authorized by the National\n\nCommittee of the political party which are selected as the at-large\n\ndelegates at the state convention of said party.\n\nD. Votes shall be allocated on a basis of not less than one-\n\nhalf (1/2) delegate vote or the minimum allowed by the national\n\nparty rules.\n\nE. Each political party shall then select, by a method to be\n\ndetermined by the party, as many delegates to the national party\n\nconvention as are allotted it by the national committee of that\n\nparty.\n\nF. No later than 5:00 p.m. on the tenth day of January, 1988,\n\nand each year thereafter in which the President and Vice President\n\nof the United States are to be elected, the Attorney General shall\n\nsubmit to the Secretary of the State Election Board notice of the\n\nmanner in which results of the next following Presidential\n\nPreferential Primary are to be certified and to whom said results\n\nare to be certified. The State Election Board shall certify results\n\naccording to the manner prescribed in the notice. The Attorney\n\nGeneral shall be required to provide said notice in such a way as to\n\nbe consistent with the methods required by the recognized political\n\nparties relative to selection of delegates to their national\n\nconventions.\n\nG. Each delegate or alternate delegate to the national\n\nconvention of his political party shall cast their vote on all\n\nballots for the candidate who received this state's vote. If that\n\ncandidate is for any reason no longer a candidate, the votes of the\n\nOklahoma delegation shall be cast for any candidate of their choice.\n\nH. If the political parties involved in the primary elections will\n\nnot accept the minimum threshold or other provisions of this\n\nsection, or have a different method of allocating the votes of all\n\ncandidates falling below such threshold, either as to the\n\ncongressional districts or statewide vote, then these matters may be\n\ngoverned by the respective political parties involved.","path":["OK Code","Title 26"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os26.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8e296bb033f047830edcdd6c5a7bdd385f4e10231706e2cd458f4c0f22ae564d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-26-26-20-103","next":"us-ok/okla.-stat.-tit.-26-26-20-105"},"notice":"GroundRules: Original legal text.
