The Secretary of the State Election Board is authorized to\n\ndeclare an election emergency for any area of the state in the event\n\nthat one or more of the following circumstances has occurred or is\n\nimminent, and such circumstances could make substantial compliance\n\nwith state and federal election laws impossible or unreasonable, or\n\ncould disrupt voter registration, voting, the tabulation of votes or\n\nthe certification of election results:\n\n1. A national or local emergency, either natural or manmade;\n\n2. Interference with election technology or election computer\n\nsystems or networks;\n\n3. A physical attack or physical threat to polling places,\n\nelection offices, election officials or voters;\n\n4. A security threat verified by federal or state security\n\nofficials;\n\n5. A criminal threat or activity verified by federal, state or\n\nlocal law enforcement officials; or\n\n6. A major failure of voting hardware, software or computer\n\nsystems or networks.\n\nThe declaration must be made in writing and must specify the\n\ncounty or counties, election or elections and dates covered by the\n\nemergency.\n\nB. The Secretary of the State Election Board shall coordinate\n\nwith the Oklahoma National Guard, the State Chief Information\n\nOfficer, the Office of Emergency Management, the Oklahoma Office of\n\nHomeland Security and such other federal or state security officials\n\nthe Secretary deems appropriate, to develop a contingency plan for a\n\nmajor election emergency.\n\nC. The Secretary of the State Election Board may request the\n\nassistance of the Oklahoma National Guard in the conduct of an\n\nelection during a declared election emergency, upon approval of the\n\nGovernor. Such assistance shall not be deemed to be in violation of\n\nthe provisions of Section 16-113 of this title or Section 4 of\n\nArticle II or Section 5 of Article III of the Oklahoma Constitution.\n\nD.
