The Secretary of the State Election Board shall designate\n\noffices in the state which provide public assistance, and offices in\n\nthe state that provide state-funded programs primarily engaged in\n\nproviding services to persons with disabilities as voter\n\nregistration agencies. The Secretary shall identify certain other\n\nagencies of state and local government and, with their agreement, of\n\nfederal and nongovernmental entities as optional voter registration\n\nagencies where voter registration services prescribed by the\n\nSecretary shall be available. Recruitment offices of the Armed\n\nForces of the United States and offices of the county election\n\nboards shall be voter registration agencies.\n\nB. Each designated voter registration agency shall, with each\n\napplication for service or assistance and with each recertification,\n\nrenewal or change of address form relating to the service or\n\nassistance of voter registration:\n\n1. Provide a voter registration application which may include\n\nall statements and declination form required under the National\n\nVoter Registration Act of 1993.\n\n2. Provide to each applicant who does not decline to register\n\nto vote the same degree of assistance with regard to the completion\n\nof the registration application form as is provided by the office\n\nwith regard to the completion of its own forms, unless the applicant\n\nrefuses such assistance.\n\n3. Require each applicant either to complete a voter\n\nregistration application or to sign a declination form.\n\nC. No information relating to a declination to register to vote\n\nin connection with an application made at an office designated a\n\nvoter registration agency may be used for any purpose other than\n\nvoter registration.\n\nD. Declination forms signed by each applicant shall be retained\n\nby designated voter registration agencies for twenty-four (24)\n\nmonths from the date of the declination.\n\nE. The identity of a voter registration agency through which a\n\nparticular voter registered may not be disclosed to the public.\n\nF. Optional voter registration agencies where voter\n\nregistration services prescribed by the Secretary shall be\n\navailable, shall provide such services during regular business hours\n\nof the agency during the time prescribed by law for making such\n\ntransactions.\n\nG. Voter registration agencies which are not county election\n\nboards shall transmit all completed voter registration applications\n\nat the close of business each week to the State Election Board in\n\npreaddressed, postage prepaid envelopes provided by the State\n\nElection Board.\n\nH. The Secretary of the State Election Board is authorized to\n\ndevelop with any agency designated in subsection A of this section a\n\nsystem to electronically transmit voter registration applications\n\nfrom the agency to the State Election Board or county election\n\nboards.
