The State Department of Health shall each month transmit to\n\nthe Secretary of the State Election Board a certified list of all\n\ndeaths of residents that have occurred within the state for the\n\nimmediately preceding month to include only the personal identifiers\n\nneeded to compare such information against the state's voter\n\nregistration database including, but not limited to, the decedent's\n\nname, date of death, and date of birth. The list shall include the\n\nlast four digits of the decedent's Social Security number and driver\n\nlicense number or state identification card number for each decedent\n\nif such information was provided to the State Department of Health.\n\nThe Secretary of the State Election Board shall transmit such list\n\nto the secretary of the county election board who shall then use the\n\nlist to ascertain those voters who are deceased, and shall remove\n\nsuch deceased person's name from the central registry and voter\n\nregistration database within thirty (30) days from the date the list\n\nwas received by the county election board. Such list shall be used\n\nonly for the purposes described in this subsection. The State\n\nElection Board and county election boards shall not release\n\ninformation, data, or records received from the State Department of\n\nHealth for the purpose of identifying deceased voters in response to\n\nan Oklahoma Open Records Act request and shall protect the integrity\n\nof the vital records data to the extent required of the State\n\nDepartment of Health by Section 1-323 of Title 63 of the Oklahoma\n\nStatutes.\n\nB. The registration of a deceased voter shall be canceled by\n\nthe secretary of a county election board upon the receipt of a\n\ncertified copy of a death certificate from any person or upon the\n\nexecution by the next of kin of such deceased voter of a form and\n\nupon the nature of proof of the fact thereof as prescribed by the\n\nSecretary of the State Election Board. Such form must be executed\n\nin person by the deceased voter's next of kin at the county election\n\nboard office, in which case it shall be witnessed by the secretary\n\nor other designated employees, at the deceased voter's precinct\n\npolling place or at the next of kin's precinct polling place in the\n\nsame county on the day of any election, in which case it shall be\n\nwitnessed by the inspector of such precinct, or the form may be\n\npersonally signed by the next of kin, such signature to be notarized\n\nby a notary public or witnessed by two persons whose signatures and\n\naddresses shall appear on the form, and returned to the county\n\nelection board.\n\nC. The administrator of a nursing facility, as defined in\n\nSection 1-1902 of Title 63 of the Oklahoma Statutes, or the\n\nadministrator of a State Veterans Home established pursuant to Title\n\n72 of the Oklahoma Statutes, also may execute a form prescribed by\n\nthe Secretary of the State Election Board to notify the secretary of\n\nthe county election board of the death of a nursing facility\n\nresident who is a registered voter. The administrator's signature\n\non such form shall be witnessed by a member of the nursing home\n\nabsentee voting board, shall be notarized or shall be witnessed by\n\ntwo persons whose signatures and addresses shall appear on the form.\n\nD. A funeral director, as defined in Section 396.2 of Title 59\n\nof the Oklahoma Statutes, may execute a form prescribed by the\n\nSecretary of the State Election Board to notify the secretary of the\n\ncounty election board of the death of a resident of the county. The\n\nfuneral director's signature on such form either shall be notarized\n\nor shall be witnessed by two persons whose signatures and addresses\n\nshall appear on the form. Upon receipt of such form or any notice\n\nsetting forth substantially the same facts and witnessed or\n\nnotarized as provided in this section, the secretary of the county\n\nelection board shall be authorized to cancel the voter registration\n\nof such deceased person.\ne on such form either shall be notarized\n\nor shall be witnessed by two persons whose signatures and addresses\n\nshall appear on the form. Upon receipt of such form or any notice\n\nsetting forth substantially the same facts and witnessed or\n\nnotarized as provided in this section, the secretary of the county\n\nelection board shall be authorized to cancel the voter registration\n\nof such deceased person.\n\nE. The registration of a deceased voter who was a member of the\n\nOklahoma National Guard or the Armed Forces of the United States and\n\nwho died in the line of duty may be canceled by the secretary of a\n\ncounty election board upon the receipt of notification of the\n\nvoter's death from the Oklahoma National Guard or the Armed Forces\n\nof the United States. The Secretary of the State Election Board may\n\nprescribe the forms of such notification to be accepted by the\n\ncounty election board in order to cause the registration of the\n\nvoter to be canceled. The Secretary shall further request the\n\nOklahoma National Guard and the Armed Forces of the United States to\n\nprovide notifications to the county election board as provided for\n\nin this section.\n\nF. 1. The Secretary of the State Election Board shall obtain\n\nofficial death records from the Social Security Administration. The\n\nSecretary of the State Election Board shall compare such death\n\nrecords against the state's voter registration database. Any\n\npossible match of a death record to a registered voter shall be\n\ntransmitted to the secretary of the county election board in the\n\ncounty in which the voter is registered. The secretary of the\n\ncounty election board shall ascertain any voter who is deceased, and\n\nshall remove such deceased person's name from the central registry\n\nand voter registration database.\n\n2. The Secretary of the State Election Board is authorized to\n\nobtain official death records from other states. If such data is\n\nobtained, the Secretary of the State Election Board shall compare\n\nsuch death records against the state's voter registration database.\n\nAny possible match of a death record to a registered voter shall be\n\ntransmitted to the secretary of the county election board in the\n\ncounty in which the voter is registered. The secretary of the\n\ncounty election board shall ascertain any voter who is deceased, and\n\nshall remove such deceased person's name from the central registry\n\nand voter registration database.\n\n3.
