Stat. tit. 26, § 26-5-125","heading":"Sheriff to serve notice - Secretary of election board","body":"made agent for constructive service.\n\nService shall be made by the sheriff of the county of residence\n\nof the contestee as to all offices, except that of sheriff, in which\n\ncase the same shall be served by the county clerk of the appropriate\n\ncounty, and the certificate of returns of such sheriff or county\n\nclerk, showing the inability to make such service within the\n\naforementioned time, shall be deemed sufficient proof of the absence\n\nof the contestee, or the inability to serve such petition and notice\n\nupon him, and to justify the constructive service herein provided.\n\nWhen personal service is impossible, within said time, it is hereby\n\nmade the duty of said petitioner to serve said true copies upon the\n\nsecretary of the appropriate election board. Provided that for the\n\npurpose of such constructive service, the Secretary of the State\n\nElection Board and the secretaries of the county election boards are\n\nhereby made and constituted the service agents for all candidates\n\nwho file declarations of candidacy with them. By filing his\n\ndeclaration of candidacy, each candidate shall thereby be\n\nconclusively presumed to have accepted the terms and provisions\n\nhereof and specifically the aforesaid constructive service.
