Stat. tit. 26, § 26-7-116.1","heading":"Provisional ballots - Persons authorized to use -","body":"Counting - Release of information - Retention.\n\nA. Provisional ballots shall be available for all elections\n\nconducted by the county election board. Provisional ballots shall\n\ninclude all offices, candidates and questions and shall be identical\n\nto the regular ballots for each precinct. The Secretary of the\n\nState Election Board shall promulgate rules and shall prescribe\n\nmaterials necessary for the implementation of provisional ballots.\n\nB. Persons who are not listed in the precinct registry, but who\n\nclaim to be registered voters in the precinct and eligible to vote\n\nin the election, shall be entitled to vote a provisional ballot upon\n\nexecution of an affidavit prescribed by the Secretary of the State\n\nElection Board. Registered voters required to show identification,\n\nas described in Section 7-114, 14-115.4 or 14-121 of this title and\n\nwho are unable to show one of the acceptable forms of identification\n\ndescribed in such sections, shall be entitled to cast a provisional\n\nballot. Persons identified in Section 14-121 of this title shall be\n\nentitled to vote a provisional ballot upon execution of an affidavit\n\nprescribed by the Secretary of the State Election Board. Persons\n\nwho are listed in the precinct registry for a partisan primary\n\nelection, but who dispute the political affiliation indicated by\n\nsuch precinct registry, shall be entitled to vote a provisional\n\nballot for a party other than the one indicated. However, such\n\nprovisional ballot shall be counted only if evidence is found by the\n\nsecretary of the county election board of the voter’s valid voter\n\nregistration in the party for which the provisional ballot was cast.\n\nC. Provisional ballots shall be segregated from the regular\n\nballots cast in the precinct in the manner prescribed by the\n\nSecretary of the State Election Board and shall not be inserted in\n\nthe precinct voting device. Information provided by a person who\n\nvotes a provisional ballot shall be investigated by the secretary of\n\nthe county election board after the election. A provisional ballot\n\nshall be counted only if it is cast in the precinct of the voter’s\n\nresidence and if evidence of the provisional voter’s valid voter\n\nregistration, or of the voter’s identity, is found, except a\n\nprovisional ballot cast by a voter identified in Section 14-121 of\n\nthis title shall be counted.\n\nD. No information concerning provisional ballots, except the\n\nnumber of provisional ballots cast in the county, shall be made\n\npublic by any election official prior to 1:00 p.m. on Friday\n\nfollowing the election. The county sheriff shall secure sealed\n\nballot transfer cases containing provisional ballots that have been\n\ncounted after 1:00 p.m. on Friday following the election until 5:00\n\np.m. on Tuesday next succeeding the election or, in the event a\n\nrecount contest is filed, until such times as the transfer cases\n\nare delivered to the district courtroom.\n\nE. In the event that the secretary of any county election board\n\nis unable to complete the investigation and verification of\n\nprovisional ballots by 1:00 p.m. on Friday following the election,\n\nthe Secretary of the State Election Board shall be authorized to\n\nextend the period for the investigation and verification of\n\nprovisional ballots. When such an extension is required by any\n\ncounty for a statewide election, the extension shall apply\n\nstatewide. The Secretary shall promulgate rules establishing\n\nprocedures for requesting and granting such extensions.\n\nF.
