Stat. tit. 26, § 26-7-139","heading":"Short title - Prohibit the Private Funding of Elections","body":"Act – Violations - Penalties.\n\nA. This act shall be known and may be cited as the \"Prohibit\n\nthe Private Funding of Elections Act\".\n\nB. As used in this section:\n\n1. \"Person\" means any individual, proprietorship, firm,\n\npartnership, joint venture, syndicate, labor union, business trust,\n\ncompany, association, committee, corporation, whether or not\n\noperated for profit, or any other organization or group of persons\n\nacting in concert, or any other nongovernmental third-party entity;\n\nand\n\n2. \"Public funds\" means funds derived from taxes, fees,\n\nincluding candidate filing fees, and other sources of public revenue\n\nlawfully appropriated or expended by Congress, the Legislature, or\n\nany other governmental entity, or funds from an entity that is\n\nauthorized to pay for an election pursuant to state law.\n\nC. 1. All costs and expenses of conducting and administrating\n\nelections shall be paid for with public funds; provided nothing in\n\nthis section shall apply to franchise elections described in\n\nSections 5(a) and 5(b) of Article XVIII of the Oklahoma\n\nConstitution.\n\n2. No government official or election official shall solicit,\n\ntake, or otherwise accept from any person, any contribution,\n\ndonation, or anything else of value for purposes of conducting or\n\nadministrating any election pursuant to the provisions of this\n\ntitle.\n\n3. No person shall offer or provide any contribution, donation,\n\nor anything else of value for purposes of conducting or\n\nadministrating any election pursuant to the provisions of this\n\ntitle.\n\nD. 1. For the purposes of this section, the following shall\n\nnot be considered a contribution, donation, or thing of value:\n\na. providing space or property for use as a polling place\n\nor in-person absentee voting site at no charge or at a\n\nbelow-market cost,\n\nb. persons who volunteer their labor as precinct\n\nofficials, absentee voting board members, or as\n\nelection workers,\n\nc. persons who volunteer their labor to assist the county\n\nelection board or the State Election Board during\n\ncandidate filing, on Election Day, during in-person\n\nabsentee voting, or at other times,\n\nd. food or beverage items of nominal value provided to\n\nprecinct officials, absentee voting board members, or\n\nelection officials,\n\ne. items of nominal value including, but not limited to,\n\npens, sanitizer and cleaning supplies, or\n\nf. airing or publication of public service announcements\n\nor press releases issued by the State Election Board\n\nor a county election board.\n\n2. Donations not directly related to the administration of\n\nelections, may be accepted by the Secretary of the State Election\n\nBoard or secretary of the county election board only upon written\n\napproval by the Governor and written notification sent to the\n\nSpeaker of the Oklahoma House of Representatives and President Pro\n\nTempore of the Oklahoma State Senate.\n\nE. A willful and intentional violation of this act shall be\n\npunishable as follows:\n\n1. A first violation shall constitute a misdemeanor and, upon\n\nconviction, be punishable by a fine not to exceed Five Thousand\n\nDollars ($5,000.00).\n\n2. A second violation shall constitute a misdemeanor and, upon\n\nconviction, be punishable by a fine not to exceed Ten Thousand\n\nDollars ($10,000.00).\n\n3. A third or any subsequent violation shall constitute a\n\nfelony and, upon conviction, be punishable by a fine not to exceed\n\nFifty Thousand Dollars ($50,000.00), or by imprisonment in the\n\ncustody of the Department of Corrections for a term of not less than\n\ntwo (2) years nor more than five (5) years, or by both such fine and\n\nimprisonment.","path":["OK Code","Title 26"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os26.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"65b9c82b984fea9643aa2702f525ed454abd37acea54ea94a2c57a1475f8d9e0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-26-26-7-138","next":"us-ok/okla.-stat.-tit.-26-26-8-101"},"notice":"GroundRules: Original legal text.
