If a recount is to be conducted using electronic voting\n\ndevices, the devices used shall be tested for accuracy by the county\n\nelection board, giving all contestants, or their agents, an\n\nopportunity to view the testing procedure. In conducting a recount\n\nusing electronic voting devices, the county election board shall\n\nopen the transfer cases containing regular ballots and counted\n\nprovisional ballots from each requested precinct or for absentee\n\nballots individually and shall assign the ballots to one or more\n\nvoting devices operated by persons appointed by the secretary of the\n\ncounty election board. The county election board shall supervise\n\nsuch counting and its decision shall be final in all cases. The\n\ncounty election board shall have the authority, by a majority vote,\n\nto determine if a ballot is valid and if the ballot should be\n\ncounted. Each contestant is entitled to have a watcher present at\n\neach place where a voting device is being used. The watcher shall\n\nbe limited to a challenge, in writing, of any action taken by\n\noperators of the voting devices. Such challenge shall be made\n\nimmediately to the county election board, whose decision on the\n\nchallenge shall be final.\n\nB. In conducting a manual recount of ballots, the county\n\nelection board shall open the transfer cases containing regular\n\nballots and counted provisional ballots from each requested precinct\n\nor for absentee ballots individually and shall assign the ballots to\n\na group of counters appointed by the secretary of the county\n\nelection board. Counters shall then conduct the recount in the same\n\nmanner as provided by law for counting ballots in Primary, Runoff\n\nPrimary and General Elections. The county election board shall\n\nsupervise such counting and its decision shall be final in all\n\ncases. The county election board shall have the authority, by a\n\nmajority vote, to determine if a ballot is valid and if the ballot\n\nshould be counted. Each candidate affected by or individual\n\npetitioning for the recount is entitled to have a watcher present at\n\neach place where a count is being made. The watcher shall be\n\nlimited to a challenge, in writing, of any decision made by the\n\ncounters with regard to counting of a ballot. Such challenge shall\n\nbe made immediately to the county election board, whose decision on\n\nthe challenge shall be final. Each group of counters shall have\n\nrepresentation of at least two political parties, where possible.\n\nThe counters shall be appointed from among the registered voters of\n\nthe county and shall meet such qualifications as may be imposed for\n\na precinct inspector, judge or clerk.
