Stat. tit. 26, § 26-8-117","heading":"Expenses of recount","body":"Deposits accompanying petitions shall be used by the appropriate\n\nelection board to defray the actual expenses of a recount. Expenses\n\nshall include mileage and salaries of the county election board\n\nmembers, which shall be made on a per diem basis at the same rate as\n\nfor normal compensation; salaries for counters deemed necessary by\n\nthe secretary of the board to conduct an expedient and accurate\n\nrecount; the expense of service of process; court reporter fees and\n\ntranscript expense; travel reimbursement for the court reporter and\n\nthe presiding judge; mileage and per diem of witnesses; and for all\n\nother actual and necessary expenses. The balance, if any, shall be\n\nreturned to the contestant. In the event the contestant is\n\nsuccessful in the recount, the deposit shall be returned to the\n\ncontestant, and the expense of the recount shall be borne by the\n\ncounty or state, as the case may be.
