Stat. tit. 26, § 26-8-120","heading":"Petition alleging irregularities - Procedure","body":"When a petition alleging irregularities other than fraud is\n\nfiled, said petition must allege a sufficient number of\n\nirregularities and of such nature as to:\n\n1. Prove that the contestant is lawfully entitled to be\n\ncertified the party's nominee or to be issued a certificate of\n\nelection, or to have his name appear on the Runoff Primary Election\n\nballot; or\n\n2. Prove that it is impossible to determine with mathematical\n\ncertainty which candidate is entitled to be certified as the party's\n\nnominee or to be issued a certificate of election, or to have his\n\nname appear on the Runoff Primary Election ballot.\n\nAdditional irregularities may be presented at the hearing if not\n\nknown to the contestant at the time the petition is filed. If such\n\nallegations are not made, the petition shall be deemed frivolous by\n\nthe presiding judge and shall be dismissed. Said petition must be\n\naccompanied by either a cashier's check or certified check in the\n\namount of Two Hundred Fifty Dollars ($250.00) for each county\n\naffected by the petition. Said petition must set forth specific\n\nallegations of irregularities in certain precincts or in the casting\n\nof absentee ballots. If said petition is filed in the manner herein\n\nprovided, the district judge of the county or such other judge as\n\nmay be assigned by the Supreme Court shall hear and determine said\n\nissue in the same manner as provided for a petition alleging fraud.\n\nOn the day of the hearing, the contestee may file an answer to the\n\npetition or may file a cross petition setting forth in detail, as\n\nrequired of petitioner herein, such claim of irregularities. A\n\ncross petition must be accompanied by either a cashier's check or\n\ncertified check in the amount of Two Hundred Fifty Dollars ($250.00)\n\nfor each county affected by the cross petition.
