Where a condemnation proceeding is instituted by any person,\n\nagency, or other entity to acquire real property for use as provided\n\nin Section 9 of this title or Section 52, 60, or 61 of Title 52 of\n\nthe Oklahoma Statutes and a jury trial is requested by the owner of\n\nany right, title, or interest in such real property, or by both such\n\nowner and the condemning authority, and the award of the jury\n\nexceeds the greater of the award of the court-appointed\n\ncommissioners or the last timely written offer of just compensation\n\nmade by the condemning authority by at least ten percent (10%), the\n\nowner of any right, title, or interest in such real property may be\n\npaid such sum as in the opinion of the court will reimburse such\n\nowner for his or her reasonable attorney, appraisal, and engineering\n\nfees actually incurred because of the condemnation proceedings.\n\nSuch determination by the court shall be appealable to the Supreme\n\nCourt in the same manner as any other final order. The written\n\noffer of just compensation will be considered timely for purposes of\n\nthis subsection if the offer is made at any time prior to seventy-\n\nfive (75) days after the report of the court-appointed commissioners\n\nis filed. The final award of such sums shall be paid by the person,\n\nagency, or other entity which sought to condemn the property.\n\nB. Where a condemnation proceeding is instituted for the\n\npurposes set forth in subsection A of this section and the final\n\njudgment is that the real property cannot be acquired by\n\ncondemnation, if the party instituting the proceeding abandons such\n\nproceeding, or if a jury trial is requested only by the condemning\n\nauthority, and the award of the jury exceeds ninety percent (90%) of\n\nthe greater of the award of the court-appointed commissioners or the\n\nlast written offer of just compensation made by the condemning\n\nauthority, the owner of any right, title, or interest in such real\n\nproperty may be paid such sum as in the opinion of the court will\n\nreimburse such owner for his or her reasonable attorney, appraisal,\n\nand engineering fees actually incurred because of the condemnation\n\nproceedings. Such determination by the court shall be appealable to\n\nthe Supreme Court in the same manner as any other final order. The\n\nwritten offer of just compensation will be considered timely for\n\npurposes of this subsection if it is made at any time prior to\n\nseventy-five (75) days after the report of the court-appointed\n\ncommissioners is filed.
