The Attorney General shall prepare a written statement that\n\nincludes a \"Landowner's Bill of Rights\" for a property owner whose\n\nreal property may be acquired by a person, acquiring agency, or\n\nother entity through the use of the entity's eminent domain\n\nauthority under this title or Title 66 of the Oklahoma Statutes.\n\nThe statement shall be made available to the public and written in\n\nplain language designed to be easily understood by the average\n\nproperty owner.\n\nB. The Landowner's Bill of Rights shall notify each property\n\nowner of the right to:\n\n1. Notice of the proposed acquisition of the owner's property;\n\n2. A bona fide good-faith effort to negotiate by the entity\n\nproposing to acquire the property;\n\n3. An assessment of damages to the owner that will result from\n\nthe taking of the property;\n\n4. A hearing under this title, including a hearing on the\n\nassessment of damages;\n\n5. An appeal of a judgment in a condemnation proceeding,\n\nincluding an appeal of an assessment of damages; and\n\n6. First refusal or right of first offer if the acquired land\n\nis ever sold by the state or any state agency or any person who\n\nacquired the land through the use of eminent domain authority. If\n\nthe landowner chooses to exercise this right, the price would be the\n\nlower of either the current market value or the price received by\n\nthe landowner under the eminent domain sale. This right shall be\n\navailable to the landowner in the original eminent domain sale and\n\nto the first generation of heirs.\n\nHowever, acquired land may be transferred to another state\n\nagency without prompting the first refusal or right of first refusal\n\nas provided in this paragraph.\n\nC. The statement shall include:\n\n1. The title \"Landowner's Bill of Rights\"; and\n\n2. A description of:\n\na. the condemnation procedures provided by this title,\n\nb. the condemning entity's obligations to the property\n\nowner,\n\nc. the property owner's options during a condemnation,\n\nincluding the property owner's right to object to and\n\nappeal an amount of damages awarded, and\n\nd. the property owner's right of first refusal or right\n\nof first offer if the acquired land is ever sold by\n\nthe state or any state agency or any person who\n\nacquired the land through the use of eminent domain\n\nauthority.","path":["OK Code","Title 27"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"52024e71f60fb36d60e0f231593ed39725132bc41a034a9b0d37f3ea8b76bceb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27-27-17","next":"us-ok/okla.-stat.-tit.-27-27-19"},"notice":"GroundRules: Original legal text.
