Stat. tit. 27, § 27-19","heading":"Notice to landowner – Groundwater rights","body":"Condemning authorities seeking to acquire surface rights for a\n\npublic purpose shall provide written notice to the landowner subject\n\nto the acquisition that the landowner may elect to retain, through\n\nseverance, the groundwater rights, if any, that are attached to the\n\nproperty to be acquired. If the landowner elects to retain such\n\ngroundwater rights, the acquisition shall be limited to surface\n\nrights and exclude groundwater rights; however, an owner of\n\ngroundwater rights shall not have a right of access to the acquired\n\nsurface rights and no person may construct, maintain or operate any\n\nwater well, drilling equipment or lines on or under the surface\n\nacquired by the condemning authority without the express written\n\npermission of the condemning authority.
