Stat. tit. 27, § 27-2","heading":"Condemnation procedure for state lands","body":"Before any public corporation, municipality or other entity or\n\nperson authorized to exercise the right of eminent domain under\n\nexisting law, shall have the right to condemn or take any part of\n\nsuch lands, a plat of the grounds proposed to be taken, showing the\n\npart of the particular subdivision, shall be prepared and filed with\n\nthe Governor of said state, together with a sworn statement of the\n\nengineer or superintendent in charge of such public work, that the\n\ntaking of such lands is necessary to the exercise of the powers of\n\nsuch municipality or corporation; and it shall be the duty of the\n\nGovernor to appoint three disinterested persons, resident\n\nhouseholders of the county in which such land is located, who shall\n\nfirst take an oath to fairly and impartially appraise the value of\n\nthe ground so taken, and the damage to the remaining parts of such\n\nsubdivision by the taking thereof, and the said appraisers shall\n\nnotify the Governor and the officers of such corporation of the time\n\nand place when they will proceed to appraise such damage, and at\n\nsuch time and place, upon actual view of the premises, the said\n\nappraisers shall meet and appraise the damage, in writing, and\n\nreturn one copy thereof under their signatures to the Governor of\n\nthe state, and one copy to the principal officer of such corporation\n\nor municipality in charge of such construction, and if either party\n\nis aggrieved they may, within ten (10) days, appeal to the district\n\ncourt of the county where such land is located, in the same manner\n\nthat appeals are taken from judgment of justices of the peace, where\n\nthe amount of such damage shall be tried by a jury, as other causes\n\nare tried. In case no appeal is taken from the award of such\n\nappraisers, such corporation or municipality shall have the right to\n\noccupy such grounds by the paying into the State Treasury the amount\n\nof such award. In case either party appeals, such corporation or\n\nmunicipality shall have the right to occupy such grounds upon giving\n\nbond in treble the amount of the award, with sureties to be approved\n\nby the clerk of the district court where such appeal is pending, to\n\nthe effect that the corporation or municipality will pay said award\n\nif such appeal be dismissed, or shall pay any judgment finally\n\nrendered in said action if the same shall be tried.","path":["OK Code","Title 27"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cae3df679e73ade11828bdbd5d6990bdc2c164f25492ff79737728660dbe15d5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27-27-19","next":"us-ok/okla.-stat.-tit.-27-27-29"},"notice":"GroundRules: Original legal text.
