Except as otherwise provided in this section, any person,\n\nfirm or corporation organized under the laws of this state, or\n\nauthorized to do business in this state, to furnish light, heat or\n\npower by electricity or natural gas, or any other person,\n\nassociation or firm engaged in furnishing lights, heat or power by\n\nelectricity or natural gas shall have and exercise the right of\n\neminent domain in the same manner and by like proceedings as\n\nprovided for railroad corporations by laws of this state.\n\nB. The power of eminent domain shall not be used for the siting\n\nor building of wind energy facilities, solar energy facilities,\n\nbattery storage facilities, hydrogen gas facilities, or other\n\nrenewable energy facilities on private property.\n\nC. Prior to seeking to exercise eminent domain for an electric\n\ntransmission facility rated greater than three hundred (300)\n\nkilovolts, any person, firm, or corporation under the purview of\n\nsubsection A of this section must have obtained a Certificate of\n\nAuthority from the Corporation Commission.\n\nD.
