Stat. tit. 27A, § 27A-1-1-203","heading":"State environmental agencies - Establishment of rules","body":"for issuance or denial of permits or licenses and complaint\n\nresolution.\n\nA. Each state environmental agency and each state agency with\n\nlimited environmental responsibilities, within its areas of\n\nenvironmental jurisdiction, shall promulgate, by rule, time periods\n\nfor issuance or denial of permits and licenses that are required by\n\nlaw. Any such matter requiring an individual proceeding shall be\n\nresolved in accordance with the rules of the agency and any\n\napplicable statutes. The rules shall provide that such time periods\n\nshall only be extended by agreement with the licensee or permittee\n\nor if circumstances outside the agency's control prevent that agency\n\nfrom meeting its time periods. If the agency fails to issue or deny\n\na permit or license within the required time periods because of\n\ncircumstances outside of the agency's control, the agency shall\n\nstate in writing the reasons such licensing or permitting is not\n\nready for issuance or denial.\n\nB. 1. Each state environmental agency and each state agency\n\nwith limited environmental responsibilities shall promulgate rules\n\nestablishing time periods for complaint resolution as required by\n\nlaw.\n\n2. Complaints received by any state environmental agency or\n\nstate agency with limited environmental responsibilities concerning\n\na site or facility permitted by or which clearly falls within the\n\njurisdiction of another state environmental agency or state agency\n\nwith limited environmental responsibilities shall be immediately\n\nreferred to the appropriate agency for investigation and resolution.\n\nSuch investigation shall be made by the appropriate division and\n\nemployees of the appropriate agency.\n\nC.
