The Office of the Secretary of the Environment shall\n\ncoordinate monitoring lakes in the State of Oklahoma and identify\n\nthose lakes which it determines to be eutrophic as defined by\n\nOklahoma's Water Quality Standards.\n\nB. No person may discharge wastewaters from a point source\n\nwithin or outside of this state which will foreseeably enter a lake\n\nin this state which has been identified as eutrophic by the\n\nOklahoma's Water Quality Standards without subjecting such\n\nwastewaters to the best available technology as identified in the\n\nfederal Clean Water Act for nitrogen and phosphorous. The Office of\n\nthe Secretary of the Environment shall coordinate the monitoring of\n\nall lakes it identifies as eutrophic and notify by certified mail\n\nany person who discharges wastewater which enters such lakes in\n\nviolation of this section of the provisions of this section and\n\nshall order such person to immediately cease and desist from any\n\nfurther violation of this section.\n\nC. Any person who violates the provisions of subsection B of\n\nthis section shall be guilty of a misdemeanor punishable by a\n\npenalty of not more than One Hundred Dollars ($100.00) per day for\n\neach day on which a violation occurs. The Attorney General is\n\nauthorized to prosecute violations of this section. Venue and\n\njurisdiction shall be proper in a county which contains all or part\n\nof a eutrophic lake which is the subject of a discharge in violation\n\nof this section.\n\nD. 1. In addition to the penalty provided in subsection C of\n\nthis section if a person continues to violate subsection B of this\n\nsection after having received notification from the Secretary of the\n\nEnvironment to cease and desist, such person shall be guilty of a\n\nmisdemeanor punishable by a fine of not more than Ten Thousand\n\nDollars ($10,000.00) per day.\n\n2. If the owner of a facility which discharges wastewater in\n\nviolation of this subsection is a corporation authorized to do\n\nbusiness in this state, the court may enter an order directing the\n\nsuspension of any authorization to do business in this state and of\n\nthe charter or other instrument of organization, under which the\n\ncorporation may be organized and the forfeiture of all corporate or\n\nother rights inuring thereunder. The order of suspension and\n\nforfeiture shall have the same effect on the rights, privileges and\n\nliabilities of the corporation and its officers and directors as a\n\nsuspension and forfeiture ordered pursuant to Section 1212 of Title\n\n68 of the Oklahoma Statutes for failure to pay franchise tax.\n\nAdditionally, all officers and directors of a corporation found to\n\nbe in violation of this subsection shall be personally liable for\n\nany fine imposed pursuant to this subsection.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bd69c4f0bfbe48284fa2b0d48defa8054390e5582b37dff1f5ce1e127ab4016d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-1-2-101","next":"us-ok/okla.-stat.-tit.-27a-27a-1-2-103"},"notice":"GroundRules: Original legal text.
