As used in this act:\n\n1. \"Acquisition closing date\" means the date on which ownership\n\nof, or a direct or indirect majority interest in the ownership of, a\n\nregulated facility or operation is acquired in an asset purchase,\n\nequity purchase, merger or similar transaction;\n\n2. \"Audit report\" means the final report in a written document\n\nwhich contains the comments and recommendations of the auditor;\n\n3. \"Environmental or health and safety audit\" or \"audit\" means\n\na systematic voluntary evaluation, review or assessment of\n\ncompliance with environmental or health and safety laws or with any\n\npermit issued under an environmental or health and safety law\n\nconducted by an owner or operator, an employee of an owner or\n\noperator, a person, including an employee or independent contractor\n\nof the person, that is considering the acquisition of a regulated\n\nfacility or operation, or an independent contractor of:\n\na. a regulated facility or operation, or\n\nb. an activity at a regulated facility or operation;\n\n4. \"Environmental or health and safety law\" means:\n\na. a federal or state environmental or occupational\n\nhealth and safety law, or\n\nb. a rule, regulation or regional or local law adopted in\n\nconjunction with a law described by subparagraph a of\n\nthis paragraph;\n\n5. \"Owner or operator\" means a person who owns or operates a\n\nregulated facility or operation;\n\n6. \"Penalty\" means an administrative, civil or criminal\n\nsanction imposed by the state to punish a person for a violation of\n\na statute or rule. The term does not include a technical or\n\nremedial provision ordered by a regulatory authority; and\n\n7. \"Regulated facility or operation\" means a facility or\n\noperation that is regulated under an environmental or health and\n\nsafety law.\n\nB. A person acts willfully for purposes of this act if the\n\nperson acts willfully within the meaning of Section 92 of Title 21\n\nof the Oklahoma Statutes.\n\nC.
