A court or administrative hearings official with competent\n\njurisdiction may require disclosure of a portion of an audit report\n\nin a civil or administrative proceeding if the court or\n\nadministrative hearings official determines, after an in camera\n\nreview consistent with the appropriate rules of procedure, that:\n\n1. The privilege is asserted for a fraudulent purpose;\n\n2. The portion of the audit report is not subject to the\n\nprivilege under Section 8 of this act; or\n\n3. The portion of the audit report shows evidence of\n\nnoncompliance with an environmental or health and safety law and\n\nappropriate efforts to achieve compliance with the law were not\n\npromptly initiated and pursued with reasonable diligence after\n\ndiscovery of noncompliance.\n\nB. A party seeking disclosure under this section has the burden\n\nof proving that paragraph 1, 2 or 3 of subsection A of this section\n\napplies.\n\nC. Notwithstanding Section 250 et seq. of Title 75 of the\n\nOklahoma Statutes, a decision of an administrative hearings official\n\nunder paragraph 1, 2 or 3 of subsection A of this section is\n\ndirectly appealable to a court of competent jurisdiction without\n\ndisclosure of the audit report to any person unless so ordered by\n\nthe court.\n\nD. A person claiming the privilege is subject to sanctions as\n\nprovided by Section 3226.1 of Title 12 of the Oklahoma Statutes if\n\nthe court finds that the person willfully or knowingly claimed the\n\nprivilege for information as provided in Section 8 of this act.\n\nE.
