If an audit report is obtained, reviewed or used in a\n\ncriminal proceeding, the administrative or civil evidentiary\n\nprivilege established by Section 5 of this act is not waived or\n\neliminated for any other purpose.\n\nB. Notwithstanding the privilege established by Section 5 of\n\nthis act, a regulatory agency may review information that is\n\nrequired to be available under a specific state or federal law, but\n\nthat review does not waive or eliminate the administrative or civil\n\nevidentiary privilege if applicable.\n\nC. If information is required to be available to the public by\n\noperation of a specific state or federal law, the governmental\n\nauthority shall notify the person claiming the privilege of the\n\npotential for public disclosure before obtaining the information\n\nunder subsection A or B of this section.\n\nD. If privileged information is disclosed under subsection B or\n\nC of this section on the motion of a party, a court or the\n\nappropriate administrative official shall suppress evidence offered\n\nin any civil or administrative proceeding that arises or is derived\n\nfrom review, disclosure or use of information obtained under this\n\nsection unless the review, disclosure or use is authorized under\n\nSection 8 of this act.
