Stat. tit. 27A, § 27A-1012","heading":"Legislative findings and declarations","body":"The Legislature hereby finds that there are one or more public\n\ntrusts having the State of Oklahoma as beneficiary which hold\n\npermits issued under the National Pollution Discharge Elimination\n\nSystem (NPDES), pursuant to the Federal Water Pollution Control Act,\n\nas amended by the Federal Clean Water Act, 33 U.S.C., Section 1251\n\net seq. In some instances, the state beneficiary public trust\n\nholding the NPDES permit receives waste water streams from third\n\nparties into a central waste water treatment system owned and\n\noperated by the public trust, and treats the commingled waste\n\nstreams in the central waste water treatment system before\n\ndischarging the resulting effluent pursuant to an NPDES permit into\n\nnavigable waters of the United States of America located in this\n\nstate. A state beneficiary public trust such as described in the\n\npreceding sentence hereof shall be referred to in this act as a\n\n\"Central Treatment Trust\", or a \"CTT\". The Legislature finds that\n\nthere is uncertainty as to whether treatment facilities owned and\n\noperated by a CTT constitute \"treatment works\" that are publicly\n\nowned within the meaning of 33 U.S.C., Sections 1292 and 1317(b).\n\nThe Legislature declares that there is a need to provide a mechanism\n\nfor resolving this uncertainty. The Legislature further declares\n\nthat a CTT should have the authority to make the election provided\n\nfor in Section 3 of this act, whereupon for purposes of owning and\n\noperating its waste water treatment facilities only, such a CTT\n\nshall have the powers granted to it by Section 4 of this act, and in\n\nconjunction therewith, the Department of Environmental Quality,\n\nsubsequently referred to in this act as \"Department\", shall exercise\n\nthe powers granted to it pursuant to Sections 4 and 5 of this act.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4567934a61514dbacdbd529f4170886a7ea4a0a612c9305bbd6a65a4f5d5bcaf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-1011","next":"us-ok/okla.-stat.-tit.-27a-27a-1013"},"notice":"GroundRules: Original legal text.
