Stat. tit. 27A, § 27A-2-1-102","heading":"Definitions","body":"As used in the Oklahoma Environmental Quality Code:\n\n1. \"Administrative hearing\" means an individual proceeding,\n\nheld by the Department when authorized by the provisions of this\n\nCode and conducted pursuant to the Administrative Procedures Act,\n\nthis Code and rules promulgated thereunder, for a purpose specified\n\nby this Code. \"Administrative hearing\" includes \"administrative\n\npermit hearing\", \"enforcement hearing\" and \"administrative\n\nenforcement hearing\" within the context of this Code. An\n\n\"administrative hearing\" shall be a quasi-judicial proceeding;\n\n2. \"Administrative Procedures Act\" means the Oklahoma\n\nAdministrative Procedures Act;\n\n3. \"Board\" means the Environmental Quality Board;\n\n4. \"Code\" means Chapter 2 of this title;\n\n5. \"Department\" means the Department of Environmental Quality;\n\n6. \"Enforcement hearing\" means an individual proceeding\n\nconducted pursuant to the Administrative Procedures Act, this Code\n\nand rules promulgated thereunder, for the purpose of enforcing the\n\nprovisions of this Code, rules promulgated thereunder and orders,\n\npermits or licenses issued pursuant thereto. The term\n\n\"administrative hearing\" shall mean the same as \"enforcement\n\nhearing\" when held for enforcement purposes. An \"enforcement\n\nhearing\" shall be a quasi-judicial proceeding;\n\n7. \"Environment\" includes the air, land, wildlife, and waters\n\nof the state;\n\n8. \"Executive Director\" means the Executive Director of the\n\nDepartment of Environmental Quality;\n\n9. \"Industrial wastewater treatment permit\" shall mean permits\n\nissued by the Department after July 1, 1993, under Section 2-6-501\n\nof Title 27A of the Oklahoma Statutes, and waste disposal permits\n\nissued on or before June 30, 1993, by the Oklahoma Water Resources\n\nBoard for land application of industrial waste or surface\n\nimpoundments or disposal systems for industrial waste or wastewater;\n\n10. \"Nonpoint source\" means the contamination of the\n\nenvironment with a pollutant for which the specific point of origin\n\nmay not be well defined;\n\n11. \"Person\" means an individual, association, partnership,\n\nfirm, company, public trust, corporation, joint-stock company,\n\ntrust, estate, municipality, state or federal agency, other\n\ngovernmental entity, any other legal entity or an agent, employee,\n\nrepresentative, assignee or successor thereof;\n\n12. \"Pollution\" means the presence in the environment of any\n\nsubstance, contaminant or pollutant, or any other alteration of the\n\nphysical, chemical or biological properties of the environment or\n\nthe release of any liquid, gaseous or solid substance into the\n\nenvironment in quantities which are or will likely create a nuisance\n\nor which render or will likely render the environment harmful or\n\ndetrimental or injurious to public health, safety or welfare, or to\n\ndomestic, commercial, industrial, agricultural, recreational, or\n\nother legitimate beneficial uses, or to livestock, wild animals,\n\nbirds, fish or other aquatic life, or to property;\n\n13. \"Public meeting\" means a formal public forum, held by the\n\nDepartment when authorized by the provisions of this Code, and\n\nconducted by a presiding officer pursuant to the requirements of\n\nthis Code and rules promulgated thereunder, at which an opportunity\n\nis provided for the presentation of oral and written views within\n\nreasonable time limits as determined by the presiding officer.\n\nViews expressed at a \"public meeting\" shall be limited to the topic\n\nor topics specified by this Code for such meeting. \"Public meeting\"\n\nshall mean a \"public hearing\" when held pursuant to requirements of\n\nthe Code of Federal Regulations or the Oklahoma Pollutant Discharge\n\nElimination System Act, and shall be synonymous with \"formal public\n\nmeeting\" and \"informal public meeting\" as used within the context of\n\nthis Code and rules promulgated thereunder. A \"public meeting\"\n\nshall not be a quasi-judicial proceeding;\n\"Public meeting\"\n\nshall mean a \"public hearing\" when held pursuant to requirements of\n\nthe Code of Federal Regulations or the Oklahoma Pollutant Discharge\n\nElimination System Act, and shall be synonymous with \"formal public\n\nmeeting\" and \"informal public meeting\" as used within the context of\n\nthis Code and rules promulgated thereunder. A \"public meeting\"\n\nshall not be a quasi-judicial proceeding;\n\n14. \"State environmental agency\" includes the:\n\na. Oklahoma Water Resources Board,\n\nb. Oklahoma Corporation Commission,\n\nc. State Department of Agriculture,\n\nd. Oklahoma Conservation Commission,\n\ne. Department of Wildlife Conservation,\n\nf. Department of Mines,\n\ng. Department of Public Safety,\n\nh. Department of Labor,\n\ni. Department of Environmental Quality, and\n\nj. Department of Civil Emergency Management; and\n\n15. \"Waters of the state\" means all streams, lakes, ponds,\n\nmarshes, watercourses, waterways, wells, springs, irrigation\n\nsystems, drainage systems, storm sewers and all other bodies or\n\naccumulations of water, surface and underground, natural or\n\nartificial, public or private, which are contained within, flow\n\nthrough, or border upon this state or any portion thereof, and shall\n\ninclude under all circumstances the waters of the United States\n\nwhich are contained within the boundaries of, flow through or border\n\nupon this state or any portion thereof.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e428565a5d2edb12e08eb282986db5b6e0d831ad7f9cd687549b58809372c54a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-1-101","next":"us-ok/okla.-stat.-tit.-27a-27a-2-1-111"},"notice":"GroundRules: Original legal text.
